Common use of Return to Former Position Clause in Contracts

Return to Former Position. ‌ A regular employee, who has been bumped by a more senior employee, or who has been notified of layoff and bumps a more junior employee pursuant to Article 15.03 (Bumping Rights), and who remains continuously employed in some other regular position, shall receive preference in returning to their original position should it become vacant within twelve (12) calendar months of their having left that position, provided always that a more senior previously laid off employee who applies for such position having the required qualifications, experience, skill and ability to perform the work, shall always receive preference over the original incumbent in filling that position.
