Common use of Return to Work After Maternity Leave Clause in Contracts

Return to Work After Maternity Leave. (a) An employee shall confirm her intention of returning to work by notice in writing to the employer given not less than four weeks notice prior to the expiration of her period of maternity leave. (b) An employee, upon returning to work after maternity leave or the expiration of the notice required by clause 7.11.13.1(a) hereof shall be entitled to the position which she held immediately before proceeding on maternity leave or, in the case of an employee who was transferred to a safe job pursuant to 7.11.6 hereof, to the position which she held immediately before such transfer or in relation to an employee who has worked part-time during the pregnancy, the position she held immediately before commencing such part-time work.
