Common use of Return to Work from Unpaid Leave Clause in Contracts

Return to Work from Unpaid Leave. An employee who returns from unpaid family 7 or medical leave within the time provided in this Article is entitled the same seniority accrued before 8 the date on which leave commenced, subject to layoff provisions, to the following in ranked order: 9 A. The same position he/she held when the leave commenced; or 10 B. A position with equivalent status, benefits, pay and other terms and conditions of 11 employment.
