Right to Return to Bargaining Unit. Any employee who is a member of the Bargaining Unit and accepts a promotion to supervisory status will no longer be considered a member of the Bargaining Unit. However, such person will have a right to return to the Bargaining Unit within two (2) years of having accepted a position as a supervisor. In the event the employee voluntarily returns to the Unit or is terminated as a supervisor, the employee may return to a comparable position within the Bargaining Unit at a wage level they would have had if they had remained a member of the Bargaining Unit. Their seniority, however, will be frozen as of the date they left the Bargaining Unit.

  • Right to Return A promoted employee shall have the right to return to his/her previous position provided that he/she notifies his/her Department Head and the Secretary of the Civil Service Board of his/her intention to do so within 60 calendar days of the date the employee commences work in the promoted position.

  • Protection of Bargaining Unit Work The Employer shall not assign work normally performed by members of this bargaining unit to persons outside the bargaining unit, to the point that it directly results in the termination, layoff or reduction in normal hours of any bargaining unit member The Employer shall not enter into any agreement that restricts or purports to restrict in any way the employment of and assignment of work to Nurses covered by this Collective Agreement without prior consultation and discussion with the Union’s Labour Relations Officer for the life of this Agreement.   • Failure to Return to Work If, upon the expiration of FMLA or CFRA Leave, or any District approved extension thereof including General Leave, an employee fails to return to work and no additional leave has been authorized, the employee shall be considered to have automatically resigned from his or her position. In such cases, the employee will receive advance notification of the District’s intent to implement an automatic resignation.
