The California Education Code shall be available, and the District Office shall provide copies of specific Education Code provisions upon request of the Association and/or unit member. Both documents shall be made accessible to individual unit members. E. The Association Faculty Representative, upon request, shall be granted a minimum of five minutes during regular faculty meetings to announce the agenda for upcoming Association business. F. The Association president shall be granted a leave of at least one-half (1/2) of each service day during the term of office. A schedule will be mutually agreed upon by the President and Superintendent or designee prior to the beginning of the school year. G. However, an Association employee may not serve as a substitute for an academic staff member in respect of any provision of this Agreement, which specifies the involvement of the latter. 10.5 Where this Agreement recognizes the right of the Association to have a member representative or observer serve on a University committee, that member representative or observer must be a member of the academic staff, subject to 10.4. 10.6 The Governors recognize the right of academic staff members to participate in meetings of the Association provided that such participation does not interfere with the performance of their duty to the University. All such services will be provided on a cost recovery basis. 5.2 Subject to availability, the Employer will allow the Association reasonable use of Nipissing University reproduction services, computing facilities, and audiovisual equipment on a cost recovery basis. 5.3 The Employer will provide the Association with suitable office space on the University campus. 5.4 Subject to availability, the Employer will provide the Association with suitable meeting rooms as required, free of charge, provided this can be done without interrupting the instructional programs of Nipissing University. 5.5 A Member's service to the Association, the Canadian Association of University Teachers (CAUT) and the Ontario Confederation of University Faculty Associations (OCUFA) will be considered as a portion of administrative or other community service in assessment of workload and the evaluation of performance. In these contexts, it will be treated in the same manner as similar duties performed in the academic unit, faculty, Senate and University committees, and duties undertaken for learned or professional societies. 5.6 The Association shall have access to sites for conducting business when it does not interfere with the instructional program and may enjoy the privileges afforded under the Board of Education policy on use of facilities. The Employer agrees that representatives of the Association, designated by the Association, shall each have their normal assigned duties reduced to provide service to the Association without prejudice to their salaries, benefits, or any of their rights and privileges within the University. Disputes about the assignment of duties to these employees shall be referred for resolution to the Joint Committee for the Management of the Agreement. 10.5.10 The Employer agrees that in relation to Association business, the Association, its officials and its staff shall be free from search and seizure in their persons, their offices, their mail and electronic mail, their files and computer files, and their other records and effects; and that they shall be free from all forms of surveillance, electronic or otherwise, except as may be required by and in accordance with the procedures of the law. 10.5.11 Except where a serious allegation of misconduct involving computer use has been made against an employee, the employer agrees that the computer files and electronic mail and media of employees shall not be examined. The Association shall be made accessible to individual unit membersaware of any filtering of electronic mail and media for any purpose, including spam filtering. E. The Association Faculty Representative, upon request, shall be granted a minimum of five minutes during regular faculty meetings to announce the agenda for upcoming Association business. F. The cost to the Association for replacement of a Member designated by the Association shall not exceed the cost of stipendiary replacement, where such replacementis possible. A Member may be provided one of these four (4) course releases in addition to any other course releases may have in only one year, not in consecutive years. An annual statement of the Association concern dues which have been deducted from salary during the calendar year shall be provided to each Member on a bulletin board in Income Tax slip by February each school in the Districtyear. The President of the Association, or someone designated by the President of the Association, and a second Member designated by the President of the Association, shall have observer status at meetings of the Board of Directors. The President of the Association, or someone designated by the President of the Association, shall have observer status at the following bodies in the School: Finance and Audit Committee of the Board of Directors, Joint Senate Committee, Academic Council. The President or someone designated by the President shall receive notice of all meetings and all documentation circulated to Members of these bodies except for documentation associated with closed session portions, and shall be made accessible entitled to individual unit membersattend all meetings except for closed session portions. E. 7. Work in any year by Members of the Bargaining Unit on the Association's Executive Committee, the Joint Health and Safety Committees, or other committees or sub- committees shall be considered by the Board as service to the academic community performed by the Member in any year. Such work shall be included in, and covered by, Articles 1.8, 2.1 to and including 2.15 (public liability insurance, Academic and Professional Career). The President will be paid for overload work by the Employer in the amount of $3,500 per annum and the Chief Negotiator will be paid for overload work by the Employer in the amount of $7,000 per annum. 8. The President of the Association Faculty Representativeor someone designated by the President, upon requestand one other person elected from amongst a group consisting of the bargaining unit and senior administrators who are otherwise excluded from the bargaining unit but who have the right of reversion to the bargaining unit, shall be granted voting Members of the Pension Committee. The Association President shall have reasonable access to the following: 1. Agenda and minutes of all Board of Trustees meetings at the time of dissemination; 2. University policies and procedures C. Upon written request, public documents as defined in Section 149.43 O.R.C. shall be made available to the Association. The University may assess the Association the standard copy fee charged to other campus organizations for any copies requested. D. The Association shall be permitted to use the University‟s classrooms, lounges, and grounds facilities at no cost, unless the University implements a parking fee. Other University facilities shall be provided as per rates established by University policy on an incremental cost basis. Any additional cost incurred by the University shall be paid by the Association upon submission of an appropriately documented charge. E. The Association shall be authorized to use University-owned office and instructional equipment. Any supplies consumed with the use of the Intra-District mail service, District email and other electronic communication methods used by the District and unit member’s mailboxes for communication to unit members. All communications equipment shall be signed paid by an authorized representative of the Association. C. Authorized F. The Association shall be permitted to use the University‟s interdepartmental mail facilities. G. The Association shall be permitted to use the University telephone and long distance system in order to conduct official Association business. Long distance charges shall be paid by the Association. Charges to the Association for such services will be the same as those assessed other campus groups and individuals. I. Duly authorized representatives of the Association who are not employed by the University shall be permitted to transact official business with Association members on University premises during normal business on school property at reasonable timeshours, provided such business does not interfere with the employees‟ duties.
