ASSOCIATION AND TEACHER RIGHTS. A. Pursuant to the Michigan Public Employment Relations Act, the Board hereby agrees that every employee of the Board shall have the right freely to organize, join and support the Association for the purpose of engaging in collective bargaining or negotiation and other concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under color of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage or deprive or coerce any teacher in the enjoyment of any rights conferred by the Act or other laws of Michigan or the Constitution of Michigan and the United States; that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his membership in the Association, the teacher's participation in any activities of the Association or collective professional negotiations with the Board, or their institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment. B. Nothing contained herein shall be construed to deny or restrict to any teacher rights he may have under the Michigan General School Laws or other applicable laws and regulations. The rights granted to teachers hereunder shall be deemed to be in addition to those provided elsewhere. C. The local Xxxxxxxx Education Association and its representatives shall have the right to use school buildings at all reasonable after school hours for meetings, provided that when special custodial service is required, the Board may make a reasonable charge therefore, provided that this shall not interfere with or interrupt normal school operations. D. Duly authorized representatives of the Association and their respective affiliates shall be permitted to transact official Association business on school property at all reasonable times, provided that this shall not interfere with or interrupt normal school operations. E. The Association shall have the exclusive right to post notices of activities and matters of Association concern on teacher bulletin boards, at least one of which shall be provided in each school building. The Association may use the district intra-mail service and teacher mail boxes for communications to teachers. F. ASSOCIATION AND TEACHER RIGHTS. A. Pursuant to the Michigan Public Employment Relations Act, the Board hereby agrees that all teachers shall have the right to freely organize, join and support the Association for the purpose of engaging in collective bargaining. The Board and Association agree not to discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of membership or non- membership in the Association, participation in any activities of the Association or collective bargaining with the Board, or the institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment. B. The Association, its members and duly authorized representatives of the Michigan Education Association and National Education Association will have the right to use school buildings for meetings and to transact official Association business other than during student instruction time. A building use form will be completed in the event of a general Association meeting. These times may be extended by permission from the Superintendent. In the exercise of this right, the Association shall schedule its meetings with the building principal, shall not displace any previously scheduled events or classes, and shall not interfere with or interrupt normal school operations. C. The Association shall have reasonable use of school-owned equipment for Association business when such equipment is not otherwise in use. The Association shall pay for the cost of all materials and supplies incident to such use, and for the cost of repair of any equipment damaged through such use by negligence, neglect, improper care or operation of the equipment, tampering or failure to perform normal cleaning and maintenance operations incident to the use of the equipment and the facility. Reasonable shall be defined as use in accordance with past practice. D. Teacher bulletin boards, mail boxes, intra office and building communications will be made available to the Association and its members for Association business. Teacher bulletin boards shall be those bulletin boards accessible only to the teachers and reserved for their use. E. Xxxxxxxx to Act 379 of the Public Acts of 1965, the Board hereby agrees that every employee of the Board shall have the right freely to organize, join, and support the Association for the purpose of engaging in collective bargaining or negotiation and other lawful concerted activities for mutual aid and protection. As a duly elected body exercising governmental power under the color of law of the State of Michigan, the Board undertakes and agrees that it will not directly or indirectly discourage, deprive or coerce any teacher in the enjoyment of any rights conferred by Act 379 or other laws of Michigan, of the Constitutions of Michigan and the United States; that it will not discriminate against any teacher with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association, his/her participation in any activities of the Association or collective professional negotiations with the Board, nor his/her institution of any grievance, complaint or proceeding under this Agreement or otherwise with respect to any terms or conditions of employment. B. The Association represents all employees in the bargaining unit. C. All employees in the bargaining unit are bargaining unit members. Association members are those that pay membership dues. D. Each bargaining unit member can freely choose to become a member of the Association, or to not become a member of the Association. Paying association dues is not a condition of employment; an employee cannot and will not be terminated because the employee chooses or chooses not to pay association dues. If an employee chooses not to become an Association member he/she will remain a bargaining unit member, remain entitled to representation by the Association, remain covered by this collective bargaining agreement, and remain entitled to any benefits set forth in this collective bargaining agreement. The Board will not tolerate harassment or discrimination against any employee who chooses to become an association member or chooses not to become an association member. Any employee who believes he/she has been harassed or discriminated against in violation of this subsection should complain as set forth in the board’s harassment policy. Any employee deemed to have harassed and/or discriminated against another employee because that employee chose or chose not to be an association member, or chose or chose not to pay association dues, shall be subject to appropriate discipline. ...
ASSOCIATION AND TEACHER RIGHTS. A. The Association, on its own behalf, hereby retains and reserves unto itself, without limitations, all powers, rights, authority, duties and responsibilities conferred upon and invested in it by the School Code and the Public Acts and Laws of the State, the Constitution of the State of Michigan and/or United States. B. The Association and its representatives shall be granted the use of a room in a designated school building for Association business upon obtaining written approval of the Principal of that building, providing that reasonable advance notice is given requesting the use of the building. It is understood that approval will only be given for meetings held when school is not in session and not in conflict with scheduled activities. C. The Association and its representatives shall be granted the use of office and audio-visual equipment upon obtaining written approval each time from the building principal. Equipment shall be used in the building in which it is normally housed. D. The Association shall be provided in each building a bulletin board for the express purpose of posting notices to carry on Association business, such as notices of meetings, educational programs, etc. E. The Board agrees to make available to the Association, in response to reasonable requests, all available information that is of public record pertaining to the operation of Bangor Township Schools. Such requests will be responded to in written format as outlined in the Freedom of Information Act, Article 15.235, and Section 5. F. The teachers shall be entitled to full rights of citizenship and no religious or political activities of any teacher, or the lack thereof, shall be grounds for any discipline or discrimination with respect to the professional employment of such teacher, provided such activities are not carried on within the confines of the school and/or school grounds during normal teaching hours, and/or school-connected activities, and further provided that such activities shall not result in time off the job. G. The Superintendent of Schools or his designee shall meet bi-monthly with the designated association representative on matters concerning the operation of Bangor Township Schools. H. The Association President will be notified of each Board of Education Meeting.

B. The parties recognize the right to invoke the assistance of the Michigan Employment Relations Commission as pertains to Act 379. C. The Association and its members shall continue to have the right to use school facilities at reasonable hours for meetings for the purpose of conducting necessary Association business as in the past. Arrangements shall be made with the Principal of the building in question in advance of the time and place of all such meetings. The Association shall provide all materials and supplies incident to such use. 1. The Association shall have the right to place notices, circulars, and other material on a designated bulletin board and in teachers' mail boxes including electronic mail. Copies of all such material shall be given to the building principal, but his advance approval shall not be required. 2. The Association may have reasonable use of the school mail and delivery services. 3. The Association may use the public address system of a building to announce the time of meetings at the time regular building announcements are read. Special announcements must be scheduled before classes are in session or after they have been dismissed. D. The Association may post notices on the bulletin boards in the teachers' lounges. The inter-school mail service may be used by the Association or its individual members. D. A telephone will be available for teacher use in each classroom. All long distance calls billed to the school must be fully logged. All personal long distance calls, other than those to home, must be charged to the home phone or credit card. Staff will be billed at regular rates for personal long distance calls to their home. Unlogged personal long distance calls will be billed at triple the rate. E. The Board agrees to make available all public information related to the financial matters of the District. Such information may include the year-end audit report, the official budget, agendas and minutes of all Board meetings and membership data, together with any information which may be necessary for the Association to process any grievance. ASSOCIATION AND TEACHER RIGHTS. A. The Board will inform the Association of any new or modified fiscal, budgetary, tax programs, construction programs or major revision of educational policy, which are proposed, or under consideration. The Association will be given the opportunity, if it requests the opportunity, to make its views known to the Board with respect to said matters prior to adoption and/or general publication. It is not the intent of the Association to impede Board functions. B. The Board agrees that it will not discourage, deprive, coerce or harass any teacher in the enjoyment of any rights conferred by the common and statutory laws and the Constitution of Michigan and the United States; that it will not discriminate against any teacher with respect to any matter subject to the terms of this agreement by reason of membership or participation in the activities of the Association. The Association agrees that it shall not discourage, deprive, coerce, harass or discriminate against any employee of the Board of Education with respect to the enjoyment of any rights conferred by the laws of the Constitution of Michigan and the United States. C. The provision of this agreement, including wages, hours, terms and conditions of employment, shall be applied in a manner which is not arbitrary or discriminatory, and without regard to race, religion, color, origin, sex, or marital status. D. The Association and its members shall have the right of reasonable use of school buildings, equipment internet, e-mail, and facilities when scheduled, with the approval of the administration. The Association and its members agree to reimburse the District for costs (excluding rental costs) associated with this use. E. The teachers, administration and Board will share in the responsibility of working with students to reduce misconduct and/or anti-social behavior. F. All communications directed to a teacher in the course of his professional duties and deemed by said teacher to be of a confidential nature need not, except with the consent of said teacher, be disclosed to anyone, including but not limited to any school administrator, parent or guardian, unless said disclosure has been determined to be required by law. ASSOCIATION AND TEACHER RIGHTS. A. Nothing contained herein shall be construed to deny or restrict any teacher of rights afforded by laws and/or regulations. B. The Association and its representatives shall have the right to use the school buildings upon requisition approved by the building principal. C. The Association shall have the right to use school facilities and equipment, including typewriters, duplicating equipment, computers, calculating machines, and audiovisual equipment at reasonable times, when such equipment is not otherwise in use, provided they have the approval of the building principal. The Association shall not use materials of the District unless arrangements are made to purchase such materials. D. The Association shall have the right to post notices of its activities and matters of Association concern on teacher Association bulletin boards provided such notices are not controversial in nature and relate to normal routine Association business of the West Branch-Rose City Education Association. The Association may use the teacher mailboxes for communication to teachers. No teacher shall be prevented from wearing insignia, pins, or other identification of membership in the Association either on or off school premises. E. Upon request in writing by the Association the following reports shall be made available, if the report is completed, and in possession of the school system: 1. Annual Financial Report for the year ending June 30, after completion of the audit.’ 2. Copy of the budget that is presented for adoption by the Board. 3. List of personnel covered by this Agreement, including salaries, degree and years of experience in the system and out.
ASSOCIATION AND TEACHER RIGHTS. Nothing contained herein shall be construed to deny or restrict to any teacher, or the Association, rights they individually or collectively have under the Michigan General School Laws or any other statutes or regulations of the State or Federal Government. All rights under the Michigan Teacher Tenure Act and the Michigan Public Employment Relations Act are specifically acknowledged.
