Rights of Owners. Each Owner shall have the benefit of the following rights (in common with all persons having the like right):
Rights of Owners. Nothing set forth in this Agreement shall restrict the right of an Owner to enter on and inspect its Property, to exercise any and all of its rights and remedies under this Agreement, to direct any questions regarding operations of its Property to Property Manager, or to maintain a relationship with tenants.
Rights of Owners.
(a) Rights of Every Owner Every Owner, his tenants, servants, agents, invitees and licensees shall have the full right and liberty (in common with the Manager ) to go pass and xxxxxx over and along and to use the Development Common Areas and Facilities for all purposes connected with the proper use and enjoyment of the same.
Rights of Owners. Anything in this Indenture to the contrary notwithstanding, upon the occurrence and continuation of any Event of Default, the Majority Holders will have the right, upon providing the Trustee security and indemnity reasonably satisfactory to it against the costs, expenses and liabilities to be incurred (including reasonable attorneys’ fees, costs and expenses), by an instrument in writing executed and delivered to the Trustee, to direct the method and place of conducting all remedial proceedings to be taken by the Trustee under this Indenture.
Rights of Owners. The Owners of contiguous Lots who have a party wall or party fence shall both equally have the right to use such wall or fence, provided that such use by one Owner does not interfere with the use and enjoyment of same by the other Owner.
Rights of Owners. Rights attaching to each Share 1. Each Share allocated to Phase V of the Development shall during the residue of the Term and any renewal thereof subject to the covenants and terms contained in the Government Grant, the Principal Deed and this Deed be held by the person or persons from time to time entitled thereto together with : (a) the full and exclusive right and privilege to hold, use and occupy the Unit designated opposite to it in the First Schedule hereto; and (b) if and for so long as an Owner shall (where required) punctually make payment of the Management Charges at the time and in the manner provided in the Principal Deed and subject to the Phase V House Rules the benefit, insofar as applicable, of the easements, rights and privileges set out in Part I of the Second Schedule hereto; but subject to the exceptions and reservations set out in Part II of the Second Schedule hereto. Rights of XXX 0. XXX shall during the residue of the Term and any renewal thereof subject to the covenants and terms contained in the Government Grant, the Principal Deed and this Deed have the full and exclusive right and privilege to hold, use, occupy and enjoy the whole of Phase V Together with the appurtenances thereto save only the First Assigned Premises.
Rights of Owners. For avoidance of doubt, nothing in this Agreement shall be construed to release or waive the rights of owners of Official Checks to obtain the value of unclaimed checks in accordance with applicable state and federal laws, provided that: Delaware has no responsibility for reimbursing owners for 2011- 2017 Official Checks assigned to another Party in the Data File; and the Defendant States have no responsibility for reimbursing owners for 2006-2010 Official Checks.
Rights of Owners. 1. The Owner of each Undivided Share together with the full and exclusive right to hold use occupy and enjoy any part of the Estate shall have the benefit of the following rights and privileges SUBJECT TO the provisions of the Conditions, this Deed, the Rules and the rights of the Manager as provided in this Deed :-
(a) Full right and liberty (but SUBJECT ALWAYS TO the rights of the Manager and the First Owner herein provided) for the Owner for the time being, his tenants, servants, agents, lawful occupants and licensees (in common with all persons having the like right) to go pass or xxxxxx over and along and to use the Common Areas and Facilities for all purposes connected with the proper use and enjoyment of his Unit SUBJECT as aforesaid PROVIDED THAT:-
(i) only Owners of the Residential Units and occupiers of such Residential Units and their bona fide guests, visitors or invitees may make use of the Residential Common Areas and Facilities;
(ii) only Owners of the Flats and occupier of such Flats and their bona fide guests, visitors or invitees may make use of the Tower Common Areas and Facilities;
(iii) only Owners of the Parking Spaces and occupiers of such Parking Spaces and their bona fide guests, visitors or invitees may make use of the Carpark Common Areas and Facilities;
(iv) notwithstanding the foregoing paragraphs (a)(i), (a)(ii) and (a)(iii) of Part A of this Second Schedule, any Owner of a Unit and occupiers of such Unit and their bona fide guests, visitors or invitees may always make use of any category of the Common Areas and Facilities which such Owner, occupiers, guests, visitors or invitees are not otherwise entitled to make use of under the foregoing paragraphs (a)(i), (a)(ii) and (a)(iii) of Part A of this Second Schedule (the “Restricted Common Areas and Facilities”) for the purpose of escape or seeking refuge in case of fire or other emergency, or obtaining access to and from their respective Units (or parts thereof) or any category of the Common Areas and Facilities which they are entitled to make use of, where such access cannot practically be obtained other than through the Restricted Common Areas and Facilities or where such access is reasonably necessary for the proper use and enjoyment of the Units or the Common Areas and Facilities concerned, such right of access shall be exercisable with or without surveyors, contractors, workmen and others and with or without vehicles, plant, equipment, materials and machinery; and
Rights of Owners. Every Owner shall have a non-exclusive right and easement of use and enjoyment in and to the Common Area for the purpose for which it is intended, subject to this District Declaration as it may be amended from time to time, any easements reserved therein or granted by District Declarant or Community Declarant, any terms and conditions of the Community Declaration as it may be amended from time to time, and to any restrictions or limitations contained in any plat and in any deed conveying such property to the District Association or subjecting such property as Common Area to the District Declaration. Such non-exclusive right or easement is subject to
(i) the right of the District Association to limit the number of guests of Owners or Owners who may use the Common Area from time to time; (ii) the right of the District Association to promulgate, establish and enforce reasonable rules and regulations pertaining to the use of the Common Area; and (iii) the right of the District Association to take such steps as are reasonably necessary to maintain, preserve and protect the Common Area. Any Owner may delegate his right of enjoyment in and to the Common Area to the members of his family, his tenants, guests or invitees, as applicable, subject to reasonable regulation by the Board of Directors of the District Association and in accordance with procedures it may adopt. An Owner of a Unit who leases his Unit shall not be deemed to have delegated such rights to the Unit’s lessee, except to the extent provided in the lease. No Owner may exempt himself from personal liability for or exempt his Unit or Unplatted Parcel from any Assessments duly levied by the District Association, or release the Unit or Unplatted Parcel owned by the Owner from liens, charges, encumbrances and other provisions of this District Declaration or the rules and regulations of the District Association by (a) the voluntary waiver of the right, privilege and easement for the use and enjoyment of the Common Area; or (b) the abandonment of his Unit or Unplatted Parcel.
Rights of Owners. Except as may be specifically set forth in this Declaration (either initially or by amendment), including Exhibit "C" attached hereto, neither the Board nor the Members may adopt any rule in violation of the following provisions:
