Roads. Purchaser acknowledges that the Roads are private and may not be continuous (a) The Owner i.e., the Roads may be separated by gravel and/or paved roads located on land not owned by Seller and not being conveyed hereunder [see Subparagraph 9.a above]). Roads. 11.01 Subject to the provisions of a cutting permit or road permit, the Licensee will ensure that the specifications, standards and locations of all roads the Licensee builds on the Licence Area are consistent with the management plan and development plan in effect at the time the road is built.
11.02 Upon the expiry of a road permit or a special use permit, all improvements, including roads and bridges, constructed by the Licensee under the authority of the road permit or the special use permit will vest in the Crown, without right of compensation to the Licensee, unless otherwise specified in the road permit or special use permit.
11.03 The Licensee will not remove any improvements referred to in paragraph 11.02, unless authorized to do so by the Regional Manager.

(d) The Owner agrees to remove from all identify those roads shown on the Subdivisionmaps referred to in subparagraph 4.07(g) which the Licensee will maintain for harvesting, any treessilviculture and forest protection purposes, brush and (b) specify the maintenance operations which the Licensee will carry out to (i) protect the structural integrity of the roads referred to in subparagraph (a) and the cleared area of the road right-of-way adjoining these roads, (ii) keep drainage systems, including culverts and ditches, functional, (iii) minimize surface erosion, and (iv) ensure these roads are safe for forest harvesting or other material as designated by industrial purposes.
11.05 The Road Deactivation Plan included in the Director of Operations. The Owner shall rough grade to the Town’s specifications, the full width of all Development Plan must (a) identify those roads as shown on the Subdivision prior maps referred to in subparagraph 4.07(g) which the installation Licensee will deactivate each year over the next three years, specifying in each case whether the deactivation will be temporary, semi-permanent or construction permanent, (b) specify the operations required to (i) stabilize the roads referred to in subparagraph (a) and the cleared area of the Works. Prior road right-of-way adjoining these roads, and (ii) restore or maintain the natural drainage at each road location, (c) identify those roads shown on the maps referred to in subparagraph 4.07(g) which have been deactivated by the construction Licensee to a temporary or semi-permanent level in the past year, and any other roads that have been permanently deactivated by the Licensee in the past year, and (d) specify the type of any Worksvehicle which can access the roads referred to in subparagraph (a) or (c).
12.01 Before April 1 of each year during the term of this Licence, the topsoil shall Licensee will submit for the District Manager's approval a fire protection pre-organization plan consistent with this Licence, and will include a duty roster in the fire protection pre-organization plan.
12.02 An approved fire protection pre-organization plan is deemed to be stripped part of this Licence.
12.03 The Licensee's obligations under an approved fire protection pre-organization plan are in addition to and shall be stockpiled during do not replace its commitments in the period of construction at a location which is approved by the Director of Operations and which is conducive to the interim drainage requirements management plan or development plan or its obligations under Section 121 of the Subdivision. If developed in phases, where a through street is not maintained, the owner shall provide a revised draft plan to reflect a proposed temporary turnaround/cul-de-sac with a minimum curb radius of 12.8 metres.
(c) The Owner agrees in the subdivision agreement with the Town or a legal agreement with Niagara Region, to pay for and construct the required road upgrades for Regional Road 100 (Four Mile Creek Road) such as curbing, drainage and lighting on the west side of the roadway abutting the subdivision land to the satisfaction of the Niagara Region Planning and Development Services Department.
(d) The Owner agrees to submit detailed engineering plans for review and approval by the Niagara Region, for the proposed urbanization of Regional Road 100 (Four Mile Creek Road) in accordance with Section 6.2(c).
(e) The Owner agrees that the road and road entrance designs will be are constructed to current Town and Regional standards and subject to approved by the Town inspection at the Owner’s expenseand Region of Niagara.
(cf) All Works to be undertaken within the road allowance of Line 2 Four Mile Creek Road and Xxxxxxxxx Drive are subject to the prior approval of the TownRegion. The Owner shall obtain an entrance work permit a Regional Construction Encroachment and utility installation permit Entrance Permit from the Town Region prior to carrying out any Works within the Line 2 Road and Xxxxxxxxx Drive Regional road allowance. Applications must be made through the Permits Section of the Niagara Region Public Works Department (Transportation Services Division). The Owner shall, upon the completion of all Works, reconstruct and restore Line 2 Road and Xxxxxxxxx Drive Four Mile Creek to the satisfaction of the Director OperationsNiagara Region.

Roads. A. The Owner shall apply to New York State Department of Transportation (aNYSDOT) for a renewed permit for a new road connection to State Highway 207, as shown on the Section Map. The Owner shall construct all roads this road as the primary connection to Route 207 and use this entrance for its construction activities.
B. Access to The Project from the presently existing Murrxx Xxxnue to the site shall be restricted during the construction phases to passenger cars only and only for sale purposes. At the direction of the Village Board, the vehicular connection to the existing Murrxx Xxxnue may be abandoned after a second access and egress (the "New Road") to and from the Project has been opened and approved as shown on the Subdivision in accordance with Section Map.
C. The applicable portion of the plans approved New Road shall be surveyed on lands owned or acquired by the Director of Operations. The Village, i.e., the former railroad bed, and shall be designed by the engineer for the Owner agrees that no Works shall commence until such time as the designs, plans and specifications have been submitted to and approved by the Director of Operations in writing.
(b) The Village Engineer. Access shall be provided to the Owner agrees that and the road entrance designs will shall be constructed to built by the Owner in accordance with current Town Village standards and subject to Town inspection at the Owner’s expense.
(c) All Works to be undertaken within the road allowance of Line 2 Road and Xxxxxxxxx Drive are subject to the prior approval of the Townspecifications. The Owner shall obtain an entrance work permit and utility installation permit from at all times provide the Town Village with liability insurance in a minimum sum of Two Million ($2,000,000.00) Dollars prior to carrying out any Works within the Line 2 Road and Xxxxxxxxx Drive road allowanceits entry upon Village lands. The Owner shall, upon the completion or Owner's designated contractors shall also be required at all times to maintain worker's compensation insurance and New York State Disability Insurance and provide proof of all Works, reconstruct and restore Line 2 Road and Xxxxxxxxx Drive such insurances to the satisfaction of Village. The liability insurance policy shall name the Director Operations.
Village as additional insured, shall be written by a Class "A" rated company authorized to transact business in New York State and shall provide that it is not cancelable except on thirty (d30) The Owner agrees days prior written notice to remove from all roads shown on the Subdivision, any trees, brush or other material as designated by the Director of OperationsVillage. The Owner shall rough grade at all times save the Village harmless and keep it fully indemnified against any loss, damage or injury arising out of and/or in connection with its work upon Village owned lands.
D. All roads in the Project including the New Road from the Project to the Town’s specifications, the full width of all roads as shown on the Subdivision prior to the installation or construction of the Works. Prior to the construction of any Works, the topsoil Scotchtown Avenue shall be stripped and constructed by the Owner at Owner's sole expense.
E. In the event that the New Road is not constructed or suitable bonding not made by the Owner, then no more than fifty-five (55) certificates of occupancy shall be stockpiled during the period of construction at a location which is approved by the Director of Operations and which is conducive to the interim drainage requirements of the Subdivision. The topsoil, so stockpiled, shall be used to grade the Lots and boulevards after construction thereon in accordance with the Grading Plan. Prior to the construction of any Works, the topsoil shall be stripped and shall be stockpiled during the period of construction at a location which is approved by the Director of Operations and which is conducive to the interim drainage requirements of the Subdivision. The topsoil, so stockpiled, shall be used to grade the Lots and boulevards after construction thereon in accordance with the Grading Plan. No topsoil shall be removed from any of the Lands for any reason unless approved by the Director of Community and Development Services in writing. . The Owner agrees to the reconstruction of Line 9 Road, west of Four Mile Creek Road, from the limit of existing asphalt/curb on Line 9 Road westward to the limit of Millpond Road (dStreet ‘A’). The Owner will be responsible for the cost of work on the south side of Line 9 Road. The Town will be responsible for the cost of reconstructing the north side of Line 9 Road. The Town will require that a comprehensive cost estimate be submitted that outlines the costs of the above-mentioned work. The Town will use this estimate to contribute the applicable share of the costs. Prior to any construction taking place within the Regional road allowance, the Owner shall obtain a Regional Construction Encroachment and/or Entrance Permit. The Owner agrees, through the subdivision agreement with the Town, to pay for the required road upgrades for the west side of Regional Road 100 (Four Mile Creek Road) such as curbing, drainage and lighting to the satisfaction of the Niagara Region Planning and Development Services Department. The Owner shall enter into a separate legal agreement with the Region for the required road work. Alternative measures may be considered to the satisfaction of Fire and Emergency Services. The Owner agrees to pave all driveways between the edge of the pavement of the street and to the property line and/or sidewalk as the case may be, for the Lots/blocks shown on Schedule “B” attached hereto. That the subdivision road design complies with Regional waste collection policy to the satisfaction of the Niagara Region Planning and Development Services Department. Based on the proposed dead-end street, the owner shall provide an easement to the Region for legal access to a temporary turnaround area on private land.
(f) The Owner agrees that all proposed laneways are to be private, including maintenance of underground services as required.

(f) . The Owner shall construct a storm drainage system to adequately service the Lands and all or any portion of the ultimate drainage area in which the Lands are located. This drainage system shall be constructed in accordance with the design, plans and specifications approved by the Town. The Owner covenants and warrants that the storm drainage system will be designed and installed such that surrounding lands are not adversely impacted and that there is no increase in post development flows. The Owner shall ensure that any Lot or block or part thereof is filled with clean fill and graded so as to prevent the ponding of water on such Lot or block or part thereof, or the flooding of adjacent lots or properties. All rainwater leads shall discharge on the surface of front and/or rear lawns and away from the building and shall not be connected to the storm sewer laterals or the sanitary sewer laterals. House foundation drain shall be gravity connected to the storm sewers. Should sump pumps be required, they shall outlet to grade. The Owner shall construct a sanitary sewer drainage system to adequately service the Lands and all or any portion of the ultimate drainage area in which the Lands are located. This sanitary sewer system shall be constructed in accordance with the design, plans and specifications approved by the Town. The Owner covenants and warrants that the sanitary sewer drainage system will be designed and installed in such a way that surrounding lands are not adversely impacted. The Owner shall, prior to the issuance of the Preliminary Certificate of Completion of Primary Services, supply the Director of Operations with the Town’s standard service cards showing the location and depth of each sanitary sewer lateral and storm sewer lateral constructed to serve the buildings which are to be to be erected on the Lands. Upon completion of the Primary Services, the Owner shall have all storm sewer and sanitary sewer systems cleaned and flushed to the satisfaction of the Director of Operations. Prior to the placement of the base course asphalt, the Owner shall be responsible for carrying out an in-line inspection of all storm sewer and sanitary sewer systems by television as directed by the Director of Operations, and the report and video thereof shall be provided to the Town. In the event that results are not, in the opinion of the Director of Operations, satisfactory, then the Owner shall take such remedial steps including re-televising the repairs as may, in the opinion of the Director of Operations, be required. Prior to the placement of the base course asphalt, the Owner shall have all sanitary sewer systems tested either by infiltration or by exfiltration and the method of testing shall be in the sole direction of the Director of Operations. Prior to the placement of the base course asphalt, the Owner shall have all sanitary sewer and storm sewer systems, which have been constructed using flexible piping mandrel tested to the satisfaction of the Director of Operations. After the placement of the topcoat asphalt and prior to the Final Certificate of Completion of Services, the Owner shall have all sanitary sewer and storm sewers flushed and carry out an in-line television inspection of all sanitary sewer and storm sewers, to the satisfaction of the Director of Operations. The Owner agrees that all proposed laneways are to be privatemark the location of storm and sanitary laterals at property line with 1.2 metre markers painted white and green, including maintenance respectively, and shall ensure the same is kept clear of underground services as requireddebris, fill, equipment or material.
