Common use of Roads Clause in Contracts

Roads. (1) If any work proposed by the Company is likely to result in the severance or injury of any road (whether a public highway or not) or part thereof formed or constructed on the leased area the Company shall give notice to that effect to the municipal or other authority responsible for the care and management of the road or if there is no such authority to the Minister. (2) Such authority or the Minister (as the case may be) shall within two months after receipt of the said notice notify the Company whether or not it or the Minister requires the Company to construct an alternative road in lieu of the road or part thereof likely to be severed or injured and if so required the Company at its expense shall construct the alternative road to a standard equivalent to that of the road or part thereof it is intended to replace and in such location as such authority or the Minister may reasonably require. (3) The Company shall not commence the work proposed as aforesaid until it has complied with the provisions of the last preceding sub-clause.
