SAFETY IN CONSTRUCTION. Party B shall adopt stringent safety measures pursuant to the applicable regulations. Party B shall be responsible for any accidents resulting from its failure to adopt effective safety measures and for the expenses thus incurred. As for any injuries or deaths for which Party B is not responsible, the responsible party shall bear responsibility and the expenses thus incurred. Should any major injury or death occur, Party B shall immediately report it to the relevant departments and notify Party A's Representative pursuant to the applicable regulations. Party B shall handle such matters pursuant to the applicable government requirements. Party A shall provide necessary support for rescue operations. The party responsible for the accident shall bear the expenses thus incurred. Before working in places near power equipment, high voltage lines, underground pipes, sealed vibration-free rooms, zones with high risk of explosion or fire, and major frontage thoroughfares, Party B shall submit a list of safety measures to Party A's Representative and implement said measures after obtaining Party A's approval. Party A shall be responsible for the expense of the protective measures. When working in a poisonous or hazardous environment, Party A shall provide proper protective measures pursuant to the applicable regulations and bear the financial expenditures thus incurred.

SAFETY IN CONSTRUCTION. 9.2.3.1 Party B shall strictly take safety protection and fire protection actions according to the appropriate regulations, and shall be liable for personal injury and property damage arising from bad management. Any losses not attributable to Party B shall be borne by the corresponding responsible person. 9.2.3.2 In case of casualty accidents, Party B shall inform the appropriate departments and Party A in the first time, and shall take actions according to the requirements of the appropriate government departments. Party A shall offer necessary conditions for rescue, and shall offer assistance to deal with the accidents. Any costs and expenses incurred by the accident shall be borne by the responsible party. 9.2.3.3 Party B shall provide watch and guard based on the engineering and safety needs, and lighting and fencing required for repair construction. While constructing nearby power devices, HV lines, underground pipelines, flammable and combustible, toxic and harmful sections, and temporary vital communication lines, Party B shall negotiate the safety protection measures with Party A, and shall implement such measures with Party A’s approval, with the protection expenses borne by Party A. 9.2.3.4 While constructing in the non-empty and in-use buildings, Party B shall prepare the special safety and fire control measures, in order to guarantee property and personal safety in the building. The said measures shall be reported to Party A for approval, and Party A shall bear the corresponding costs and expenses.
SAFETY IN CONSTRUCTION. The contractor shall employ only such methods of construction, tools and plant as are appropriate for the type of work or as approved by Engineer-in-Charge in writing. The contractor shall take all precautions and measures to ensure safety of works and xxxxxxx and shall be fully responsible for the same. Safety pertaining to construction works such as excavation, centering and shuttering, trenching, blasting, demolition, electric connections, scaffolds, ladders, working platforms, gangway, mixing of bituminous materials, electric and gas welding, use of hoisting and construction machinery shall be governed by CPWD safety code, relevant safety codes and the direction of Engineer-in-Charge

  • Law; Construction This Agreement and any claim, counterclaim or dispute of any kind or nature whatsoever arising out of or in any way relating to this Agreement (“Claim”), directly or indirectly, shall be governed by, and construed in accordance with, the internal laws of the State of New York.

  • Certain Constructions (a) For purposes of this Agreement, references to the most or next most subordinate Class of Pooled Regular Certificates outstanding at any time shall mean the most or next most subordinate Class of Pooled Regular Certificates then outstanding as among the Class A-1, Class A-2, Class A-3, Class A-4, Class A-AB, Class X-A, Class X-B, Class X-D, Class X-F, Class X-G, Class X-H, Class A-S, Class B, Class C, Class D, Class E, Class F, Class G, Class H, Class J-RR and Class K-RR Certificates; provided, however, that for purposes of determining the most subordinate Class of Pooled Regular Certificates, in the event that the Class A-1, Class A-2, Class A-3, Class A-4 and Class A-AB Certificates are the only Classes of Pooled Principal Balance Certificates outstanding, the Class A-1, Class A-2, Class A-3, Class A-4, Class A-AB and Class X-A Certificates together will be treated as the most subordinate Class of Pooled Regular Certificates. For purposes of this Agreement, each Class of Certificates (other than the Class S and Class R Certificates) shall be deemed to be outstanding only to the extent its respective Certificate Balance or Notional Amount has not been reduced to zero. For purposes of this Agreement, the Class R Certificates shall be deemed to be outstanding so long as the Trust REMICs have not been terminated pursuant to Section 9.01 of this Agreement. (b) For purposes of this Agreement, except as otherwise expressly provided or unless the context otherwise requires: (i) the terms defined in this Agreement include the plural as well as the singular, and the use of any gender herein shall be deemed to include the other gender; (ii) references herein to “Articles”, “Sections”, “Subsections”, “Paragraphs” and other subdivisions without reference to a document are to designated Articles, Sections, Subsections, Paragraphs and other subdivisions of this Agreement;

  • ICIF Construction The ICIF shall be designed and constructed in accordance with Good Utility Practice. Within one hundred twenty (120) Calendar Days after the Commercial Operation Date, unless the Parties agree on another mutually acceptable deadline, Interconnection Customer shall deliver to Transmission Provider and Transmission Owner “as-built” drawings, information and documents for the ICIF, such as: a one-line diagram, a site plan showing the Generating Facility and the ICIF, plan and elevation drawings showing the layout of the ICIF, a relay functional diagram, relaying AC and DC schematic wiring diagrams and relay settings for all facilities associated with the Interconnection Customer’s step-up transformers, the facilities connecting the Generating Facility to the step-up transformers and the ICIF, and the impedances (determined by factory tests) for the associated step-up transformers and the Generating Facility. Interconnection Customer shall provide Transmission Provider and Transmission Owner with Interconnection Customer’s specifications for the excitation system, automatic voltage regulator, Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • New Construction If this contract is for a Property that is newly constructed and the new construction option is selected, coverage begins on day one (1) of month thirteen

  • DAF Construction The DAF shall be designed and constructed in accordance with Good Utility Practice. The Developer shall provide to, and coordinate with, Connecting Transmission Owner and NYISO with respect to proposed specifications for the excitation system, automatic voltage regulator, Large Generating Facility control and protection settings, transformer tap settings, and communications, if applicable.

  • Governing Law; Construction This Agreement and any claim, counterclaim or dispute of any kind or nature whatsoever arising out of or in any way relating to this Agreement (“Claim”), directly or indirectly, shall be governed by, and construed in accordance with, the laws of the State of New York. The section headings in this Agreement have been inserted as a matter of convenience of reference and are not a part of this Agreement.
