Common use of Safety Responsibilities Clause in Contracts

Safety Responsibilities. Although the MEP Engineer does not have direct safety responsibilities on the Project, it is expressly understood that the requirements of safety in conduct of the work to be performed hereunder shall be fundamental to the execution of the MEP Engineer’s work. The MEP Engineer shall perform its work with due regard to the safety of persons and property. It is a condition of this Contract, and the MEP Engineer agrees, that the MEP Engineer shall not require its employees employed in the performance of this Contract to work in surroundings or under working conditions which are unsanitary, hazardous or dangerous to personal health and safety, as determined under any applicable OSHA regulations. Applicable safety laws, rules and regulations, and codes shall be observed by the MEP Engineer and its Subconsultants. It is the responsibility of the MEP Engineer to ensure that the work of its employees and Subconsultants required hereunder is performed in a safe and workmanlike manner and in compliance with general safety standards for the performance of such work. The MEP Engineer must ensure that all its personnel are able to adhere to applicable safety laws, rules and regulations, and codes. Safety deficiencies shall be brought to the attention of the School District and the Construction Management Firm.
