Common use of Salary Upon Demotion Clause in Contracts

Salary Upon Demotion. When an employee is demoted due to voluntary or involuntary demotion, or layoff without cause, to a classification with a maximum salary range which is at least five percent (5%) lower than the maximum salary range of the former classification, the new salary shall be the same step in the lower range as was received in the higher range. An exception may be made for a medical accommodation.

Salary Upon Demotion. When Whenever an employee is demoted due to voluntary or involuntary demotion, or layoff without cause, is demoted to a classification with a maximum salary range which is at least five percent (5%) lower than the maximum salary range of the former classification, the new salary shall be that step in the new range which provides equal or, in absence thereof, the nearest lower salary to that which was received prior to the demotion. In all cases of demotion for cause, the employee shall receive the same step in the lower range as was received in the higher range. An exception may be made for a medical accommodation.
