Sales Price, Income Eligibility, Mortgage Liens and Sales Timeline. The proposed sales price of each unit will not exceed the lower of the following: 95 percent of the median purchase price for the area based on Federal Housing Administration (FHA) single family mortgage program; or the appraised value of the completed unit. Prospective buyers will apply directly with the lender of their choice for a first mortgage loan and will be reviewed through the City’s First Time Home Buyer program staff to determine income eligibility. Total household income must not exceed 80 percent of the Area Median Income as determined by HUD. The household will be referred to the Home Center for homebuyer education classes and will enter into a buy/sell agreement with the Developer. Buyers will be qualified for a first mortgage using no more than 30 percent of household income for monthly payments. Silent, zero percent interest, deferred payment loans will be secured as secondary mortgages to ensure primary mortgage payments are no more than 30 percent of total household income. Total debt ratio will be no higher than 41 percent of household income. The Developer will ensure a City-approved Montana Trust Indenture, Promissory Note and Deed Restriction are secured against the units for the secondary liens. The Deed Restriction will include the amount of HOME assistance, deferred payment restrictions, use of funds, restrictions on use, mechanisms to ensure the affordability periods are met, and recapture provisions for proceeds to be paid back to the City. These second-position liens will identify the City of Xxxxxxxx as the sole recipient for repayment of HOME funds upon resale, refinance or non-use as a primary residence. The Developer may receive and retain proceeds from the initial sale of the property to the first home purchasers in order to assist in other housing activities to benefit low income households. The City will monitor the units for non-use as a primary residence through the procedures implemented for the First Time Home Buyer program. The Developer will sell the units to income-eligible households within nine months of unit completion.

  • Minimum Site Requirements for TIPS Sales (when applicable to TIPS Sale). Cleanup: When performing work on site at a TIPS Member’s property, Vendor shall clean up and remove all debris and rubbish resulting from their work as required or directed by the TIPS Member or as agreed by the parties. Upon completion of work, the premises shall be left in good repair and an orderly, neat, clean and unobstructed condition. Preparation: Vendor shall not begin a project for which a TIPS Member has not prepared the site, unless Vendor does the preparation work at no cost, or until TIPS Member includes the cost of site preparation in the TIPS Sale Site preparation includes, but is not limited to: moving furniture, installing wiring for networks or power, and similar pre‐installation requirements. Registered Sex Offender Restrictions: For work to be performed at schools, Vendor agrees that no employee of Vendor or a subcontractor who has been adjudicated to be a registered sex offender will perform work at any time when students are, or reasonably expected to be, present unless otherwise agreed by the TIPS Member. Vendor agrees that a violation of this condition shall be considered a material breach and may result in the cancellation of the TIPS Sale at the TIPS Member’s discretion. Vendor must identify any additional costs associated with compliance of this term. If no costs are specified, compliance with this term will be provided at no additional charge. Safety Measures: Vendor shall take all reasonable precautions for the safety of employees on the worksite, and shall erect and properly maintain all necessary safeguards for protection of workers and the public. Vendor shall post warning signs against all hazards created by the operation and work in progress. Proper precautions shall be taken pursuant to state law and standard practices to protect workers, general public and existing structures from injury or damage. Smoking: Persons working under Agreement shall adhere to the TIPS Member’s or local smoking statutes, codes, ordinances, and policies.

  • THIRD-PARTY REVENUE Subrecipient shall make every reasonable effort to obtain all available reimbursement from third parties (e.g., insurers), for which persons served hereunder may be eligible. If a delay in delivery is anticipated, Vendor shall notify the TIPS Member as to why delivery is delayed and provide an updated estimated time for completion. The TIPS Member may cancel the order if the delay is not commercially acceptable or not consistent with the Supplemental Agreement applicable to the order.

  • Contract Quarterly Sales Reports The Contractor shall submit complete Quarterly Sales Reports to the Department’s Contract Manager within 30 calendar days after the close of each State fiscal quarter (the State’s fiscal quarters close on September 30, December 31, March 31, and June 30). Reports must be submitted in MS Excel using the DMS Quarterly Sales Report Format, which can be accessed at xxxxx://xxx.xxx.xxxxxxxxx.xxx/business_operations/ state_purchasing/vendor_resources/quarterly_sales_report_format. Initiation and submission of the most recent version of the Quarterly Sales Report posted on the DMS website is the responsibility of the Contractor without prompting or notification from the Department’s Contract Manager. If no orders are received during the quarter, the Contractor must email the DMS Contract Manager confirming there was no activity.

  • Current Revenues Under Texas law, a contract with a governmental entity that contains a claim against future revenues is void; therefore, each party paying for the performance of governmental functions or services must make those payments from current revenues available to the paying party.
