SB Preference. Government Code sections 14835 et seq., require a five percent (5%) preference be given to prime bidders who qualify as a small business. The rules and regulations of this law, including the definition of a small business for the delivery of goods and services, are contained in Title 2, CCR, sections 1896, and et seq. A copy of the regulations is available upon request from the OSDS. To claim the small business preference, the firm must have its principal place of business located in California, have a complete application (including proof of annual receipts) on file with the OSDS by 5:00 p.m. Pacific Standard Time on the date the final bid is due, and be verified by such office. Questions regarding the preference approval process should be directed to the OSDS at (000) 000-0000. To meet this requirement, the bidder must do the following: • Complete the SB Preference Claim Form (Attachment 12) AND • If claiming the SB Preference, attach a copy of the certification from the OSDS for each participating SB The small business preference is applied during the evaluation of the bid response and shall be computed as follows: if a non-small business has submitted the bid that has received the highest points evaluation, a preference equal to five percent (5%) of that point total shall be computed and shall constitute the small business preference amount. The preference amount shall be added to the point totals of all responsive certified small business bidders.

  • Counterparts This Agreement may be executed in two or more counterparts, each of which shall be deemed an original, but all of which together shall constitute one and the same instrument.

  • General All payments to be made by the Borrower shall be made without condition or deduction for any counterclaim, defense, recoupment or setoff. Except as otherwise expressly provided herein, all payments by the Borrower hereunder shall be made to the Administrative Agent, for the account of the respective Lenders to which such payment is owed, at the Administrative Agent’s Office in Dollars and in immediately available funds not later than 2:00 p.m. on the date specified herein.
