Common use of SCERS Clause in Contracts

SCERS. Upon separation of an employee eligible to accumulate sick leave credits for reasons of retirement, resignation and/or layoff, or death, such employee (or those entitled by law to the possession of the estate of a deceased employee) shall receive payment for thirty- three and one-third percent (33-1/3%) of the total sick leave credits accumulated (to the nearest full day) by the employee on the date of such retirement, resignation, layoff, or death.

SCERS. Upon separation of an employee eligible to accumulate sick leave credits for reasons of retirement, resignation and/or layofflayoff after service for a period of not less than two (2) years, or death, such employee (or those entitled by law to the possession of the estate of a deceased employee) shall receive payment for thirty- thirty-three and one-third percent (33-1/3%) of the total sick leave credits accumulated (to the nearest full day) by the employee on the date of such retirement, resignation, layoff, or death.
