Scope of Easement. 2.1 The Developer may, at its sole and absolute discretion and at its sole cost and expense, explore and decide upon any or all of the following options with respect to the nature and scope of the Easement:
Scope of Easement. The Avigation Easement shall apply only to those portions of the airspace above the land surface of the portion of Lot 1 designated “Avigation Easement” of Grantor’s Property which is above the "imaginary surfaces" defined in the Federal Regulations and depicted on the Xxxxxx-Xxxx Memorial Airport Layout Plan (the "Airspace"), as the same may apply to Grantor's Property as of the date hereof. The Airspace of the portion of Lot 1 designated “Avigation Easement” shall not be invaded or used by Grantor, nor shall Grantor authorize the use of the Airspace by others, without Xxxxxxx's prior written approval; provided however that this restriction shall apply only to physical obstructions and not to telecommunication, electrical or similar waves or transmissions to and from areas below the Airspace. Grantor will not construct, install, erect, or grow upon the applicable portions of Grantor's Property any structure, building, tree, or other object which extends into the Airspace, without the prior written approval of Grantee, which approval shall not be unreasonably withheld. Grantee shall have a continuing right to keep clear from the Airspace buildings, structures, or improvements of any kind, trees, or other objects, including the right to remove or demolish any portions of such obstructions which extend into the Airspace which Grantee has not previously approved.
Scope of Easement. The permanent right-of-way easement includes the right of the Grantee, its contractors, agents, and employees to enter the Easement Area at all reasonable times for the purpose of grading, locating, constructing, reconstructing, operating, maintaining, inspecting, altering and repairing within the Easement Area for use by the public a public roadway, sidewalk, and other public facilities or improvements of any type that are not inconsistent with a public right-of-way. The easement also includes the right of the Grantee, its successors and assigns, to cut, trim, or remove from the easement area any trees, shrubs, or other vegetation that in the Grantee's judgment unreasonably interfere with the Easement Area or improvements of the Grantee located therein.

Scope of Easement. 3.1 Hydro and Manitoba shall have the right and privilege during the currency of the Easement to inundate and store water on the Easement Lands in accordance with, and subject to, the provisions of this Easement Agreement; and shall and may peaceably hold and enjoy the rights, privileges and Easements hereby granted without obstruction, hindrance, molestation or interruption on the part of Canada, York Factory, or any person claiming by, through, or under Canada or York Factory.
Scope of Easement. The perpetual storm water drainage easement granted in this Agreement includes the right of Grantee, its contractors, agents, and employees to enter the premises through the Access Point at all reasonable times for the purpose of locating, constructing, reconstructing, operating, maintaining, inspecting, and repairing storm sewer, sanitary sewer and water facilities and ground surface drainage ways in the described easement area. The Pipe shall be maintained by the Grantee at its sole cost and expense. Grantee shall repair any damage to property of Grantor or pay any damages which may be caused to property of Grantor solely by Xxxxxxx's activity on, or use of, the land subject to this easement. At its sole cost and expense and promptly after completion of any work within the easement area, Grantee will restore the surface and subsurface condition of the easement area to an equal or better condition as existed prior to Grantee's work.
Scope of Easement. The easement granted by this Agreement is a right to enter and use the Easement Area for the purpose of: (1) constructing an irrigation ditch; (2) operating and maintaining the Grantee’s irrigation ditch; (3) repair of the ditch; (4) replacement and repair of the constructed and associated ditch improvements including the headwalls; and (4) the conveyance of water within those portions of the ditch which are within the Easement Area. The Parties understand and agree that, at the date of execution of this Agreement by the Parties, there exist certain structures and other encroachments within the Easement Area, including buildings, and signs and that such presently existing structures and encroachments shall be permitted to remain and continue within the Easement Area. The Grantee understands and agrees that once the irrigation ditch is constructed, the irrigation ditch may not be expanded or otherwise made to further encroach on the Easement Area without the express written consent of the Grantor.
Scope of Easement. Scope of Easement. This Agreement gives Grantee the right to access the Easement Area over the Property to install, erect, operate, inspect, maintain, and replace noise monitoring equipment, along with the necessary underground and surface electrical power, telephone lines and conduit (the ”Monitoring Equipment'').
Scope of Easement. The Easement will be solely used for pedestrian ingress and egress to Grantee’s Property, with the sole exception of light maintenance vehicles that may be used under Grantee’s supervision, provided that the vehicles do not damage the Easement. The Easement is limited for the use of Grantee’s employees, agents, and volunteers, as well as selected invitees from the general public from time to time, under Grantee’s supervision and control, provided that use by those invitees will be infrequent. Otherwise, the Easement will not be used by the general public.
