Common use of Sealing and Maintenance of Meters Clause in Contracts

Sealing and Maintenance of Meters. (i) The Main Metering System and the Backup Metering System shall be sealed in the presence of representatives of Power Producer and GETCO /CTU. (ii) When the Main Metering System and / or Backup Metering System and / or any component thereof is found to be outside the acceptable limits of accuracy or otherwise not functioning properly, it shall be repaired, re-calibrated or replaced by the Power Producer and / or GUVNL / GETCO / CTU at Power Producer’s cost, as soon as possible. (iii) Any meter seal(s) shall be broken only by GETCO/ CTU’s representative in the presence of Power Producer representative whenever the Main Metering System or the Backup Metering System is to be inspected, tested, adjusted, repaired or replaced. (iv) All the Main and Check Meters shall be calibrated at least once in a period of three years. (v) In case, both the Main Meter and Check Meter are found to be beyond permissible limit of error, both the meters shall be calibrated immediately and the correction applicable to main meter shall be applied to the energy registered by the Main Meter at the correct energy for the purpose of energy accounting / billing for the actual period during which inaccurate measurements were made, if such period can be determined or, if not readily determinable, shall be the shorter of: A. the period since immediately preceding test of the relevant Main meter, or B. one hundred and eighty (180) days immediately preceding the test at which the relevant Main Meter was determined to be defective or inaccurate.

When the Main Metering System and / or Backup Metering System/Check Metering System and / or any component thereof is found to be outside the acceptable limits of accuracy or otherwise not functioning properly, it shall be repaired, re-calibrated or replaced by the Hybrid Power Producer Developer and / or GUVNL / GETCO / CTU MSETCL/MSEDCL at Hybrid Power ProducerDeveloper’s cost, as soon as possible. (iii) . Any meter seal(s) shall be broken only by GETCO/ CTUMSETCL/MSEDCL’s representative in the presence of Hybrid Power Producer Developer’s representative whenever the Main Metering System or the Backup Metering System is to be inspected, tested, adjusted, repaired or replaced. (iv) . All the Main and Check Meters shall be calibrated at least once in a period of three yearsone calender year. (v) v. In case, both the Main Meter and Check Meter are found to be beyond permissible limit of error, both the meters shall be calibrated immediately and the correction applicable to main meter shall be applied to the energy registered by the Main Meter at the correct energy for the purpose of energy accounting / billing for the actual period during which inaccurate measurements were made, if such period can be determined or, if not readily determinable, shall be the shorter of: A. a) the period since immediately preceding test of the relevant Main meter, or B. b) one hundred and eighty (180) days immediately preceding the test at which the relevant Main Meter was determined to be defective or inaccurate.

When the Main Metering System and / or Backup Metering System/Check Metering System and / or any component thereof is found to be outside the acceptable limits of accuracy or otherwise not functioning properly, it shall be repaired, re-calibrated or replaced by the Solar Power Producer and / Generator or GUVNL / GETCO / CTU MSEDCL at Solar Power ProducerGenerator’s cost, as soon as possible. (iii) . Any meter seal(s) shall be broken only by GETCO/ CTUMSEDCL’s representative in the presence of Solar Power Producer Generator’s representative whenever the Main Metering System or the Backup Metering System is to be inspected, tested, adjusted, repaired or replaced. (iv) . All the Main and Check Meters shall be calibrated at least once in a period of three yearsone year. (v) v. In case, both the Main Meter and Check Meter are found to be beyond permissible limit of error, both the meters shall be calibrated immediately and the correction applicable to main meter shall be applied to the energy registered by the Main Meter at the correct energy for the purpose of energy accounting / billing for the actual period during which inaccurate measurements were made, if such period can be determined or, if not readily determinable, shall be the shorter of: A. a) the period since immediately preceding test of the relevant Main meter, or B. b) one hundred and eighty (180) days immediately preceding the test at which the relevant Main Meter was determined to be defective or inaccurate.

(ii) 7.3.2 When the Main Metering System and / or Backup Metering System/Check Metering System and / or any component thereof is found to be outside the acceptable limits of accuracy or otherwise not functioning properly, it shall be repaired, re-calibrated or replaced by the Floating Solar Power Producer Developer and / or GUVNL / GETCO / CTU MSETCL/MSEDCL at Floating Solar Power ProducerDeveloper’s cost, as soon as possible. (iii) 7.3.3 Any meter seal(s) shall be broken only by GETCO/ CTUMSETCL/MSEDCL’s representative in the presence of Floating Solar Power Producer Developer’s representative whenever the Main Metering System or the Backup Metering System is to be inspected, tested, adjusted, repaired or replaced. (iv) 7.3.4 All the Main and Check Meters shall be calibrated at least once in a period of three yearsone calendar year. (v) 7.3.5 In case, both the Main Meter and Check Meter are found to be beyond permissible limit of error, both the meters shall be calibrated immediately and the correction applicable to main meter shall be applied to the energy registered by the Main Meter at the correct energy for the purpose of energy accounting / billing for the actual period during which inaccurate measurements were made, if such period can be determined or, if not readily determinable, shall be the shorter of: A. (a) the period since immediately preceding test of the relevant Main meter, or B. (b) one hundred and eighty (180) days immediately preceding the test at which the relevant Main Meter was determined to be defective or inaccurate.

(iii) . Any meter seal(s) shall be broken only by GETCO/ CTU/STU/DISCOM’s representative in the presence of Power Producer Renewable Energy Project Developer’s representative whenever the Main Metering System or the Backup Metering System is to be inspected, tested, adjusted, repaired or replaced. (ii) 6.3.2 When the a Main Metering System and / or Backup Metering System and / or Meter and/or a backup meter and/or any component thereof is found to be outside the acceptable limits of accuracy or otherwise not functioning properly, it shall be repaired, re-re- calibrated or replaced by the Power Producer and / or GUVNL / GETCO / CTU Solar Company and/or the Procurer at Power Producerthe Solar Company’s cost, as soon as possible. (iii) 6.3.3 Any meter seal(s) annexed with the Main Meter or the backup meter shall be broken only by GETCO/ CTUthe Procurer’s representative in the presence of Power Producer the Solar Company’s representative whenever the such Main Metering System Meter or the Backup Metering System backup meter is to be inspected, tested, adjusted, repaired or replaced. (iv) All the 6.3.4 The Main Meter and Check Meters backup meter shall be calibrated at least once in a period of three 3 (three) years. (v) 6.3.5 In case, both the Main Meter and Check Meter backup meter are found to be beyond permissible limit of error, both the meters shall be calibrated immediately and the correction applicable to main meter such Main Meter shall be applied to the energy Electricity registered by the Main Meter at the correct energy for the purpose of energy accounting / and billing for the actual period during which inaccurate measurements were made, if such period can be determined or, if determined. If this period is not readily determinable, it shall be the shorter of: A. (a) the period since the immediately preceding test of the relevant such Main meterMeter, or B. one hundred and eighty (180b) 30 (thirty) days immediately preceding the test at which the relevant such Main Meter was determined to be defective or inaccurate. Further, the Parties agree that if the quantum of error in the meters is not determinable or where both the Main Meter and the backup meter have failed to function in accordance with the specifications, then in such event, the assessment of the Electricity supplied shall be equivalent to the Electricity registered at the Main Meter during an equivalent generation period of 30 (thirty) days in the previous calendar year.

(ii) 6.2.2 When the Main Metering System and / or Backup Metering System/Check Metering System and / or any component thereof is found to be outside the acceptable limits of accuracy or otherwise not functioning properly, it shall be repaired, re-calibrated or replaced by the Power Producer and / or GUVNL / GETCO / CTU CTU/STU/DISCOM at Power Producer’s Producer‟s cost, as soon as possible. (iii) 6.2.3 Any meter seal(s) shall be broken only by GETCO/ CTU’s CTU / STU/DISCOM‟s representative in the presence of Power Producer Producer‟s representative whenever the Main Metering System or the Backup Metering System is to be inspected, tested, adjusted, repaired or replaced. (iv) 6.2.4 All the Main and Check Meters shall be calibrated at least once in a period of three yearsone year. (v) 6.2.5 In case, both the Main Meter and Check Meter are found to be beyond permissible limit of error, both the meters shall be calibrated immediately and the correction applicable to main meter shall be applied to the energy registered by the Main Meter at the correct energy for the purpose of energy accounting / billing for the actual period during which inaccurate measurements were made, if such period can be determined or, if not readily determinable, shall be the shorter of: A. a) the period since immediately preceding test of the relevant Main meter, or B. b) one hundred and eighty (180) days immediately preceding the test at which the relevant Main Meter was determined to be defective or inaccurate.

Sealing and Maintenance of Meters. (i) The Main Metering System and System, the Backup Metering System and all the ABT Compliant Meters shall be sealed in the presence of representatives of Power Producer BESSD and GETCO /CTUMSEDCL/MSETCL. (ii) When the Main Metering System and / or Backup Metering System and / or any component thereof is found to be outside the acceptable limits of accuracy or otherwise not functioning properly, it shall be repaired, re-calibrated or replaced by the Power Producer BESSD and / or GUVNL DISCOM / GETCO / CTU MSEDCL/MSETCL at Power ProducerBESSD’s cost, as soon as possible. Any meter seal(s) shall be broken only by GETCO/ CTU’s MSEDCL‟s representative in the presence of Solar Power Producer Generator‟s representative whenever the Main Metering System or the Backup Metering System is to be inspected, tested, adjusted, repaired or replaced. (iv) . All the Main and Check Meters shall be calibrated at least once in a period of three yearsone year. (v) v.
