Section 10.12. 5 In the event of layoff, the District will determine the number and type of classifications to be reduced. If 6 there is more than one employee in a classification that is to be reduced, the employee with the earliest 7 seniority date shall have preferential rights when ability and performance are substantially equal with 8 junior employees. If the District determines that seniority rights should not govern because a junior 9 employee possesses ability and performance substantially greater than a senior employee, the District 10 shall set forth in writing its reasons why to the employee(s).
