Common use of Section 8.1.1. Unworked Holidays Clause in Contracts

Section 8.1.1. Unworked Holidays. 2 Eligible employees shall receive pay equal to their normal work shift at their base rate in effect at 3 the time the holiday occurs. Employees who are on the active payroll on the holiday and have 4 worked their last scheduled shift preceding the holiday and their first scheduled shift succeeding 5 the holiday, and are not on leave of absence, shall be eligible for pay for such unworked holiday.

Employees who are on the active payroll on the holiday and have 4 worked their last scheduled shift preceding or on 19 authorized paid leave (sick leave may require a doctor’s note upon request of the holiday and their first scheduled shift succeeding 5 the holiday, supervisor) 20 and are not on leave of absenceabsence as defined in Section 9.7., shall be eligible for pay for such 21 unworked holiday. When holidays fall on a Saturday or Sunday, the District may designate 22 either the preceding Friday or the succeeding Monday as a holiday.
