Sell Contractor’s Equipment. Sell, after 15 days written notice to the Contractor, any property owned by the Contractor left on the premises or in the possession of the County and apply the net proceeds toward any such amount due the County. County may, in its discretion, employ an auctioneer or other agent for the sale of the equipment and deduct the costs of sale from any proceeds due County or, in the event there is nothing owed to County, to the Contractor. In the event the County, in its reasonable discretion, determines the costs of sale would exceed the value of the equipment, County may sell equipment as scrap and deduct the reasonable costs of sale from the proceeds.

  • Contractor’s Equipment Payment for required equipment owned by the Construction Manager or an affiliate of the Construction Manager will be based solely on an hourly rate derived by dividing the current appropriate monthly rate by 176 hours. No payment will be made under any circumstances for repair costs, freight and transportation charges, fuel, lubricants, insurance, any other costs and expenses, or overhead and profit. Payment for such equipment made idle by delays attributable to the Government will be based on one-half the derived hourly rate under this subsection.

  • Assuring Contractors’ Systems 2.1 The primary purpose of the Contractor Assurance Team is to provide the Authority with an assurance that payments to Contractors are in accordance with the Authority requirements, and that public funds are protected and value for money has been obtained.

  • Contract Work The provision of goods and services identified in the Contract constitute the contract work (Contract Work). Where an employee and their supervisor agree that certain ship repair work is of an unusually dirty or offensive nature, the employee shall be entitled to 58 cents per hour extra.

  • Selection of Subcontractors, Procurement of Materials and Leasing of Equipment The contractor shall not discriminate on the grounds of race, color, religion, sex, national origin, age or disability in the selection and retention of subcontractors, including procurement of materials and leases of equipment. The contractor shall take all necessary and reasonable steps to ensure nondiscrimination in the administration of this contract.

  • Payroll Records Contractors and Subcontractors must keep original payrolls or transcripts subscribed and affirmed as true under the penalties of perjury as required by law. For public works contracts over $25,000 where the Contractor maintains no regular place of business in New York State, such records must be kept at the work site. For building services contracts, such records must be kept at the work site while work is being performed.

  • Personnel Equipment and Material Engineer shall furnish and maintain, at its own expense, quarters for the performance of all Engineering Services, and adequate and sufficient personnel and equipment to perform the Engineering Services as required. All employees of Engineer shall have such knowledge and experience as will enable them to perform the duties assigned to them. Any employee of Engineer who, in the reasonable opinion of County, is incompetent or whose conduct becomes detrimental to the Engineering Services shall immediately be removed from association with the Project when so instructed by County. Engineer certifies that it presently has adequate qualified personnel in its employment for performance of the Engineering Services required under this Contract, or will obtain such personnel from sources other than County. Engineer may not change the Project Manager without prior written consent of County.

  • Subcontractors The Contractor will not subcontract any work under the Contract without prior written consent of the Department. The Contractor is fully responsible for satisfactory completion of all its subcontracted work. The Department supports diversity in its procurements and contracts, and requests that the Contractor offer subcontracting opportunities to certified woman-, veteran-, and minority-owned small businesses. The Contractor may contact the OSD at xxxxxxx@xxx.xxxxxxxxx.xxx for information on certified small business enterprises available for subcontracting opportunities.
