Common use of Service Date Clause in Contracts

Service Date. (a) The Supplier will advise the Client of the date on which the Supplier will seek to commence provision of the Services (the “Estimated Service Date”). Except as expressly provided in the Additional Terms Schedule, the Supplier shall not be liable for any damages whatsoever resulting from any failure to meet the Estimated Service Date. (b) The Services and the invoicing of monthly recurring Charges will commence on the date that the Supplier actually makes the Services available, whether or not the Client makes use of such Services (the “Service Date”). (c) Unless otherwise agreed upon in writing between the parties, or as otherwise provided in this Agreement, neither party may terminate this Agreement during the Initial Term.
