Settlement Class Counsel and Defendant’s Counsel Sample Clauses

Settlement Class Counsel and Defendant’s Counsel each agree to keep all information about the settlement administration processincluding without limitation all information received pursuant to Paragraph 5 of this Agreement, such as claims reports, information concerning opt-outs, and the Class List—confidential and may use it only for purposes of effectuating this Agreement.

Settlement Class Counsel and Defendant’s Counsel will review all timely filed appeals within thirty (30) days after receipt of the Claims Administrator’s list of all timely-submitted appeals and all documents related to such Settlement Class Members’ appeals. The Parties will conduct only one such review session, it being the intention of the Parties to resolve all appeals expeditiously, in good faith, and at one time.
Settlement Class Counsel and Defendant’s Counsel have created a process for Settlement Class Members to claim benefits under the Settlement. The Court preliminarily approves this process and directs the Settlement Administrator to make the Claim Form or its substantial equivalent available to Settlement Class Members in the manner specified in the Notice. The Settlement Administrator will be responsible for effectuating the claims process. Settlement Class Members who qualify for and wish to submit a Claim Form shall do so in accordance with the requirement and procedures specified in the Notice and the Claim Form. If the Final Order and Judgment is entered, all Settlement Class Members who qualify for any benefit under the Settlement but fail to submit a claim in accordance with the requirements and procedures specified in the Notice and the Claim Form shall be forever barred from receiving any such benefit, but will in all other respects be subject to and bound by the provisions in the Final Order and Judgment, including the releases contained therein.
Settlement Class Counsel and Defendant’s Counsel will take all reasonable and necessary steps, subject to the Court’s availability, to obtain entry of the Preliminary Approval Order and the Final Approval Order as expeditiously as possible.
