Common use of Sickness during annual leave Clause in Contracts

Sickness during annual leave. Where an employee becomes sick whilst on annual leave on days on which he/she would otherwise have worked, and immediately forwards to the employer a certificate of a legally qualified medical practitioner or other relevant practitioner, or a statutory declaration, as evidence of being unfit for work then the number of those days specified in the certificate or statutory declaration shall be deducted from any sick leave entitlement standing to the employee’s credit, and shall be re-credited to his/her annual leave entitlement. If annual leave loading as provided for in 30.10 has been paid in respect of sick days referred to in this subclause, such leave loading shall not be re-credited.
