Simple Cycle Mode During First Contract Year. The Purchaser has requested from the Supplier that it shall not commence or perform, before the Effective Date, any work required at the Power Plant, and shall not incur or commit any costs in relation thereto, in order to prepare the Power Plant for the production and delivery of electrical energy in accordance with this MOU. Given the fact that the Supplier will only commence or perform, after the Effective Date, the work required for the Power Plant to be ready for the production and delivery of electrical energy for the second Contract Year in accordance with this MOU, the Purchaser acknowledges and agrees that the availability of any electrical energy during the first Contract Year shall commence no earlier than six months subsequent to the Effective Date and shall be strictly on an “as available” basis and subject to any safety and prudent operating practices, as determined by the Supplier in its sole discretion; Moreover, during the first Contract Year:

  • Work During Vacation Period No employee shall be required to work during the employee's vacation once the vacation request has been approved.

  • Employee leaving during notice period An employee given notice of termination in circumstances of redundancy may terminate their employment during the period of notice.   • Addressing Objections Raised During Public Comment Period The Parties agree that the procedure contemplated for public review of this Stipulated Order and the Regional Water Board’s or its delegate’s adoption of this Stipulated Order is lawful and adequate. The Parties understand that the Regional Water Board or its delegate has the authority to require a public hearing on this Stipulated Order. If procedural objections are raised or the Regional Water Board requires a public hearing prior to the Stipulated Order becoming effective, the Parties agree to meet and confer concerning any such objections, and may agree to revise or adjust the procedure and/or this Stipulated Order as necessary or advisable under the circumstances.

  • Work During Vacation Should an employee who has commenced his scheduled vacation and agrees upon request by the Hospital to return to perform work during the vacation period, the employee shall be paid at the rate of one and one-half (1-1/2) times his basic straight time rate for all hours so worked. To replace the originally scheduled days on which such work was performed, the employee will receive one (1) vacation lieu day off for each day on which he has so worked.
