SIZE OF DWELLING; RIGHT SIZING REQUIREMENT. If at the time of conversion the Tenant is not in a unit appropriate for their family size pursuant to the New York City Housing Authority’s (“NYCHA”) Section 8 program occupancy standards, and does not have a reasonable accommodation or grievance granting permission to reside in that unit, the Tenant must move to an appropriate-sized unit. If a unit is not available in the Development, the Tenant may remain in their current unit until an appropriate- sized unit becomes available. When an appropriate-sized unit becomes available, the Tenant living in the unit not appropriately sized must either (1) move to the appropriate-sized unit within a reasonable period of time, as determined by NYCHA, but not upon less than thirty (30) days’ notice from the Owner and/or Managing Agent, or (2) request a transfer voucher to relocate outside of the Development. This requirement to right size applies whether the Tenant’s unit is on the PBV HAP Contract or the Owner is receiving a monthly housing assistance payment from NYCHA for the unit not appropriately sized. If the Owner is receiving a monthly housing assistance payment for the unit not appropriately sized, and the Tenant does not vacate this unit, NYCHA shall terminate the monthly housing assistance payment for the unit and the Tenant will cease to be a participant in NYCHA’s Section 8 Program and may be subject to eviction by the Owner and/or Managing Agent.

  • Screening Requirements Xxxxxx shall ensure that all prospective and current Covered Persons are not Ineligible Persons, by implementing the following screening requirements.

  • No Representations as to Offering Materials or Condition of Property Potential Investor understands and acknowledges that neither Owner, HFF nor any Owner/HFF Related Party makes any representation or warranty as to the accuracy or completeness of the Offering Materials or the condition of the Property in any manner. The Potential Investor further understands and acknowledges that the information used in the preparation of the Offering Materials was furnished by Owner and has not been independently verified by HFF, and is not guaranteed as to completeness or accuracy. Potential Investor agrees that neither Owner, HFF, nor any Owner/HFF Related Party shall have any liability for any reason to the Potential Investor or any of its representatives or Related Parties resulting from the use of the Offering Materials by any person in connection with the sale of, or other investments by Potential Investor in the Property whether or not consummated for any reason. Neither Owner, HFF nor any Owner/HFF Related Party is under any obligation to notify or provide any further information to Potential Investor or any Related Party if either Owner or HFF becomes aware of any inaccuracy, incompleteness or change in the Offering Materials. The undersigned acknowledges that neither Owner, HFF nor any Owner/HFF Related Party, has made any representation or warranty as to the accuracy or completeness of the Offering Materials, or the suitability of the information contained therein for any purpose whatever, and any representation or warranty in connection therewith is hereby expressly excluded. The Offering Materials provided to the undersigned are subject to, among other things, correction of errors and omissions, additions or deletion of terms, and withdrawal upon notice. The undersigned agrees that neither Owner, HFF, nor any Owner/HFF Related Party shall have any liability to Potential Investor and/or any Related Party resulting from the delivery to, or use by the undersigned of the Offering Materials or otherwise with respect thereto. Potential Investor and Related Parties shall rely only their own due diligence and investigation of the Property, including but not limited to any financial, title, environmental, physical, tenant or any other matters.

  • Installation requirements 7.8 We (if we install the System) or our contractor (if we procure a contractor to install the System) must:

  • ORDERING REQUIREMENTS Eligible Purchasers shall order Goods and/or Services from this Master Contract, consistent with the terms hereof and by using any ordering mechanism agreeable both to Contractor and Purchaser but including, at a minimum, a purchase order. When practicable, Contractor and Purchaser also shall use telephone orders, email orders, web-based orders, and similar procurement methods (collectively “Purchaser Order”). All Purchase Orders must reference the Master Contract number. The terms of this Master Contract shall apply to any Purchase Order and, in the event of any conflict, the terms of this Master Contract shall prevail. Notwithstanding any provision to the contrary, in no event shall any ‘click-agreement,’ software or web-based application terms and conditions, or any other agreement modify the terms and conditions of this Master Contract.

  • Trunk Forecasting Requirements 14.2.1 Initial trunk forecast requirements. At least ninety (90) days before initiating interconnection in a LATA, Alltel shall provide Verizon a two (2)-year traffic forecast that complies with the Verizon Interconnection Trunking Forecast Guide, as revised from time to time. This initial traffic forecast will provide the amount of traffic to be delivered to and from Verizon over each of the Interconnection Trunk groups in the LATA over the next eight (8) quarters.
