Occupancy Standards. To the extent legally possible, occupancy of the Affordable Units shall be limited to two persons per bedroom plus one additional person. Notwithstanding the foregoing, however, no residents of the Affordable Units as of the date of this Agreement shall be evicted from their apartment units solely because such residents do not meet the occupancy standards requirements of Section 307 of the Affordable Housing Agreement.

Occupancy Standards. To avoid overcrowding and prevent waste of space, program units shall be assigned in accordance with the occupancy standards set forth below, except that such standards may be waived by the Executive Director when necessary to achieve and maintain full occupancy or to comply with the preference provisions set forth in Section four (4), above. Occupancy Standards. The Affordable Unit shall be used as the principal residence of Homeowner and Homeowner's family and for no other purpose. Homeowner may have a Home Office so long as the Affordable Unit is Homeowner's and Homeowner's family's principle residence. Homeowner shall not enter into an agreement for the rental, lease, or sublease of the Affordable Unit, and Homeowner shall not otherwise rent, lease, or sublease the Affordable Unit. The maximum number of persons permitted to occupy the Affordable Unit shall not exceed the occupancy permitted pursuant to the general requirements of the United States Department of Housing and Urban Development in effect on the Effective Date of the Density Bonus Agreement, which is two persons per bedroom, plus one person (e.g., for a two bedroom unit the maximum number of persons residing in the unit can be five). The minimum occupancy standard permitted for a two-bedroom unit is one person per bedroom. Homeowner shall, commencing upon the first anniversary of the date of this Covenant first set forth above and on each succeeding anniversary thereafter, submit to the City an affidavit of occupancy in a form provided by the City. The City may grant a temporary waiver of the above requirements for good cause, in the City's sole and absolute discretion.

Occupancy Standards. The agreement shall include provisions that specify: a. Income eligibility criteria for defining housing unit affordability; b. The actual affordable sales prices or rents for affordable units, as determined by the CDC in accordance with this Article. The agreement shall also provide that the CDC may from time to time revise the sales prices and rent limits in response to changes in income limits, monthly housing costs, and the real estate market. Monthly housing costs for affordable ownership units shall include mortgage payments, property taxes, homeowners insurance and, as applicable, homeowner’s association dues and private mortgage insurance. Monthly housing costs for affordable rental units shall include the rent plus any tenant-paid utilities; c. Criteria for the certification and selection of buyers or renters, as applicable. Selection criteria may include the amount of household income and assets, household size, and the size or other special needs features of units reserved for senior, disabled or large family households; and d. A fair and equitable marketing and buyer or tenant selection process submitted by the applicant and approved in advance by the Executive Director of the CDC, to ensure the selection of eligible buyers or tenants.
Occupancy Standards. When applying to the property, the appropriately sized unit must be in the unit configuration within the development. Units are assigned according to household size and composition. If the appropriate unit size is not available at the time of application, the applicant will be put on a waiting list. Notwithstanding the foregoing, however, no current residents of Housing Units as of the date of this Agreement shall be evicted from their apartment units solely because the household does not meet the occupancy requirements of this Section 306.
