SOIL EROSION, SEDIMENTATION CONTROL AND CONTROL OF WATER POLLUTION. No changes shall be made in the contours of the Tract and no grading, excavating, removing or destruction of topsoil, trees or other vegetative cover on the Tract shall be made until such time as a plan for minimizing soil erosion and sedimentation has been reviewed and approved by the Township. Developer shall submit such a plan for soil erosion and sedimentation control to the Department of Environmental Resources of the Commonwealth of Pennsylvania. Developer shall deliver evidence of the approval of such plan to the Township prior to the date of this Agreement, and Developer shall comply with the plan during the course of construction. Developer shall use all care possible to prevent siltation and other pollution of the waters of the Commonwealth of Pennsylvania even if measures exceeding those set forth on approved plans prove necessary.

SOIL EROSION, SEDIMENTATION CONTROL AND CONTROL OF WATER POLLUTION. No changes shall be made in the contours of the Oak Drive Improvements, no grading, excavating, removing or destruction of the topsoil, trees or other vegetative cover on the area of the Oak Drive Improvements shall be made contrary to the approved Erosion and Sediment Approval letter dated December 21, 2021 and NPDES Permit No. PAC460675. The aforementioned approval and permit shall have been delivered to the Township prior to the date of this Agreement and Foxlane shall comply with said permits and Plan during the course of construction. Foxlane shall use all care possible to prevent siltation and other pollution of the waters of the Commonwealth of Pennsylvania even if measures exceeding those set forth on approved Oak Drive Plans prove necessary. Xxxxxxx further agrees to maintain reasonable control over dust or dirt blowing off the area of the Oak Drive Improvements in accordance with the rules, regulations and procedures of the Xxxxxxxxxx County Conservation District. Xxxxxxx shall indemnify Xxx for any and all governmental claims, fines or citations arising out of a violation of the provisions in this Section 12.

  • Federal Water Pollution Control Act 1. The contractor agrees to comply with all applicable standards, orders, or regulations issued pursuant to the Federal Water Pollution Control Act, as amended, 33 U.S.C. 1251 et seq.

  • Environmental Pollution Unless disposition of environmental pollution is specifically a part of this contract, PURCHASER shall immediately notify STATE of any hazardous substance(s) which PURCHASER discovers or encounters during performance of the operation. "Hazardous substance(s)" are those substances, materials, or wastes regulated by state or federal law. PURCHASER shall immediately cease operating in any particular area of the operations where a hazardous substance(s) has been discovered or encountered, if continued operations in such area would present a bona fide risk or danger to the health or well being of PURCHASER's or any subcontractor's work force. Upon being notified by PURCHASER of the presence of hazardous substance(s) on the areas of operations, STATE shall arrange for the proper disposition of such hazardous substance(s).

  • Air Transportation In accordance with the standard provision entitled International Air Transportation, any international travel requires prior written approval from the FHI360 contracts administrator.

  • Smoke Free Environment The Lessor shall make all parts of the leased premise smoke-free. "

  • Erosion Control a. The Purchaser shall construct slash and debris erosion barriers, dips, water bars or ditches in skid trails and landings as directed by the Forest Officer.
