Specific and Exclusive Management Rights. Subject to the provisions of this agreement, the Port reserves the right: a. To recruit, assign, transfer, or promote members to positions within the Department, including the assignment of employees to specific jobs; b. To suspend, demote, discharge, or take other disciplinary action against members for just cause; c. To direct and evaluate the performance of work; d. To determine the keeping of records; e. To determine the job content and/or job duties of employees, with the condition that job content and job duties are consistent with generally recognized Department functions; f. To determine methods, processes, means, and personnel necessary for providing service and Departmental operations, including but not limited to: determining the increase, diminution, or change of operations or fire equipment, in whole or in part, including the introduction of any and all new, improved, automated methods of equipment; g. To control the Departmental budget, and if deemed appropriate by the Port, to implement reduction in force; h. To schedule work as required in a manner most advantageous to the Department and consistent with requirements of municipal employment and public safety, subject to the provisions of this Agreement; i. To take whatever actions are necessary in emergencies in order to assure the proper functioning of the Department; and j. To manage and operate its Departments except as may be limited by provisions of this Agreement and applicable law.
