Split-up /spin off. The closing price of the index constituent is adjusted by the value of the spin-off, and the shares of the index constituent will be adjusted to maintain its existing weighting in the index. As the principle investment amount is re-established daily, the cash equivalent of shares acquired through the spinoff will be included in the overall market capitalization of the index. This figure will be used to establish the principle investment amount for the next day’s opening. Spun-off companies will not be added into the index at the time of the event.

  • Split Shift Except as otherwise provided in subsection B. below, any employee required to work a split shift shall be paid at a rate of five percent over and above his/her regular straight-time hourly rate of pay for the entire number of hours so worked. For purposes of this subsection "split shift" is defined as any eight hour daily tour of duty taking more than nine and one-half consecutive hours to complete.

  • No Split Shifts With the exception of the meal period, an employee's shift for the day shall be comprised of consecutive hours of work unless otherwise mutually agreed to between the employee and the Co-operative.

  • Dependent Child/Parents Separated or Divorced If two or more plans cover a person as a dependent child of divorced or separated parents, the plan responsible to cover benefits for the child will be determined in the following order: • first, the plan of the parent with custody of the child; • then, the plan of the spouse of the parent with custody of the child; and • finally, the plan of the parent not having custody of the child. If the terms of a court decree state that: • one of the parents is responsible for the healthcare expenses of the child, and the entity obligated to pay or provide the parent's benefits under that parent's plan has actual knowledge of those terms, the benefits of that plan are determined first and the benefits of the plan of the other parent are the secondary plan. • both parents share joint custody, without stating that one of the parents is responsible for the healthcare expenses of the child, the plans covering the child will follow the order of benefit determination rules outlined above.

  • Split Shifts No shift shall be split for a period longer than the regularly scheduled meal and rest periods as provided for in Article 14.08.

  • Effective Time Subject to the provisions of this Agreement, at the Closing, the Company, Parent, and Merger Sub will cause a certificate of merger (the “Certificate of Merger”) to be executed, acknowledged, and filed with the Secretary of State of the State of Delaware in accordance with the relevant provisions of the DGCL and shall make all other filings or recordings required under the DGCL.
