Statement of Dispute; Process. In the event of a dispute arising out of this Agreement either Party shall, as soon as a conflict is identified, submit a written statement of the conflict to the other Party. Within five working days of receipt of such a statement of conflict, the second Party will respond and a meeting will be arranged not more than five working days thereafter to arrive at a negotiated settlement or procedure for settlement. If, within 20 working days from the initial filing of a statement of conflict a settlement cannot be reached, the Parties agree to mediate any disagreements in good faith. Should these dispute resolution procedures fail to resolve a dispute between the parties, it is agreed that the dispute may be resolved in a court of law competent to hear the matter.

Should either Party determine the dispute cannot be resolved in mediation, the Parties agree to participate in non-binding arbitration. Should these alternative dispute resolutions procedures fail to resolve a dispute between the parties, it is agreed that the dispute may be resolved in a court of law competent to hear the matter.

  • Settlement of Dispute Any disputes under the Agreement shall be settled at first through friendly consultation between the parties hereto.
