Status of Ships. Table 6 shows the status of ships at the time of the incident. Of the nine actual incidents reported during the period December 2007 – January 2008, six involved ships that were anchored and three involved ship that were under way. Between December 2006 and January 2007, all 10 actual incidents occurred while the ships were at anchor or at berth. Of the two incidents that involved ship while steaming in October 2007, one was a Category 2 incident. In October 2006, of the eight actual incidents reported, seven involved ships that were anchored and one involved a ship that was steaming. The incident that involved ship that was steaming was a Category 2 incident. The ISC notes that ships at anchor were more vulnerable to attacks compared to ships that were steaming, and ships that were steaming if attacked were likely to be moderately significant incidents. In April 2007, of the three incidents involving ships that were steaming, one was a Category 1 incident, one was a Category 2 incident and one was a Category 3 incident. The ISC notes that majority of the incidents involving ships that were steaming were either Category 2 or Category 1 incidents.   • STATUS OF CONTRACTOR 21 CONTRACTOR is, and shall at all times be deemed to be, an independent contractor and shall be 22 wholly responsible for the manner in which it performs the services required of it by the terms of this 23 Agreement. CONTRACTOR is entirely responsible for compensating staff, subcontractors, and 24 consultants employed by CONTRACTOR. This Agreement shall not be construed as creating the 25 relationship of employer and employee, or principal and agent, between COUNTY and CONTRACTOR 26 or any of CONTRACTOR’s employees, agents, consultants, or subcontractors.   • Status of Consultant It is the intent of the parties that Consultant shall be considered an independent contractor and that Consultant, and anyone else for whom it is legally liable, shall not be considered employees, servants or agents of the City for any purpose. Furthermore, this Agreement shall not be construed to create a partnership or joint venture between the Consultant and the City. Neither Consultant nor any of its employees or contractors shall be eligible to participate in City’s industrial insurance, unemployment, disability, medical, dental, life or other insurance programs, or any other benefit or program that is sponsored, financed or provided by City for its employees. Consultant agrees that it shall be Consultant’s exclusive responsibility to pay all federal, state, or local payroll, social security, disability, industrial insurance, self-employment insurance, income and other taxes and assessments related to this Agreement. Neither FICA (Social Security), FUTA (Federal Employment), nor local, state or federal income taxes will be withheld from payments to Consultant. Consultant shall at Consultant’s expense pay and be fully liable and responsible for, and indemnity and hold harmless City from, any assessments, fines or penalties relating to Consultant’s failure to uphold any of these responsibilities.

  • Classification of Goods The classification of goods in trade between the Parties shall be in conformity with the Harmonized System.

  • Status of Parties The other party is not acting as a fiduciary for or an adviser to it in respect of that Transaction.

  • New Job Classifications 11.1 Whenever the Company determines it appropriate to create a new job classification in the bargaining unit, it shall proceed as follows.
