Category 2. 23.3.1 Liquidated damages up to $25,000 per violation may be imposed for the Category 2 events. For Category 2 events, the Contractor shall submit a written CAPA/PC to DCH for review and approval prior to implementing the corrective action. Category 2 events are monitored by DCH to determine compliance and include the following: · Substantial failure to provide medically necessary services that the Contractor is required to provide under law, or under this Contract, to a Member covered under this Contract; · Misrepresentation or falsification of information furnished to a Member, Potential Member, or health care Provider; · Failure to comply with the requirements for physician incentive plans, as set forth in 42 CFR 422.208 and 422.210; · Distribution directly, or indirectly, through any Agent or independent contractor, marketing materials that have not been approved by the State or that contain false or materially misleading information; · Violation of any other applicable requirements of section 1903(m) or 1932 of the Social Security Act and any implementing regulations; · Failure of the Contractor to assume full operation of its duties under this Contract in accordance with the transition timeframes specified herein; · Imposition of premiums or charges on Members that are in excess of the premiums or charges permitted under the Medicaid program (the State will deduct the amount of the overcharge and return it to the affected Member). · Failure to resolve Member Appeals and Grievances within the timeframes specified in this Contract; · Failure to ensure client confidentiality in accordance with 45 CFR 160 and 45 CFR 164; and an incident of noncompliance will be assessed as per member and/or per HIPAA regulatory violation. · Violation of a subcontracting requirement in the Contract.

Category 2 a. School year employees plus contiguous extended time – 205 days, including paid holidays, except for Library Assistants, who shall work five (5) workdays prior to the first day of school and five (5) workdays after the last day of school. (Usually called ten (10) month employees.) b. Ten (10) month secretaries shall not be scheduled to work the first day of a new contract year if the day is a Friday. Additionally, ten (10) month secretaries will not be scheduled to work if the last day of a new contract year is a Monday. Secretary XXx and Secretary IIIs with 205 day contracts shall work twelve (12) workdays prior to the first day of school and five (5) workdays after the last day of school. c. Due to the imperfect and changing calendar, the actual number of paid workdays may vary by a couple of days. Category I and II employees, excluding Nutrition Services Employees and employees assigned to the administration building and service building, shall work thirty (30) minutes past student dismissal at their building on the date designated by the school calendar as the teacher compensatory one-half (1/2) day for spring parent-teacher conferences. They shall be paid for actual hours worked.
Category 2. As-needed Special Environmental Services in support of Harbor Department operational and capital improvement projects in one or more of the following areas: • Cultural Resources (historical resources, archaeology and paleontology); • Air Quality, Toxic Air Contaminants, and Greenhouse Gases; • Sustainability Planning and Reporting; • Mitigation Monitoring and Reporting; and • In-House CEQA/NEPA Project Management. Special Environmental Services include, but are not limited to, data-gathering and survey of cultural resources; monitoring and reporting on general project issues and compliance with approved mitigation measures and other environmental requirements; researching new regulations and guidelines related to air quality; performing peer- reviews of technical air quality assessments; developing general protocols; preparing technical overviews and primers; and providing support in sustainability planning and developing annual sustainability reports.
Category 2. These speakers/trainers may present the MPCP segment at an UBP, conduct an NUOT, conduct a B5, and speak/train at all other approved GMTSS events (i.e., Local, District, Regional) where attendees are charged an admission fee. Category 2 Speakers must: (a) earn a minimum of AUD$4,500 in commissions each calendar quarter from one (1) or more BDCs;. (b) personally sponsor three (3) UnFranchise Owners during the previous calendar year; (c) purchase five (5) tickets from Market America for the Leadership School and submit the ticket numbers to the GMTSS Department within sixty (60) days following each Annual Convention, and five (5) tickets from Market America for the Annual Convention and submit the ticket numbers to the GMTSS Department within sixty (60) days following each Leadership School (failure to comply with this requirement will result in automatic suspension of Speakers Bureau status until such time as the required number of tickets are purchased); (d) qualify for the SABP (Shopping Annuity Bonus Programme) at least one (1) quarter per year.
