Significant Incidents. (a) If: (i) a significant incident occurs within the facility; and (ii) the incident had or has the potential to prevent or restrict Ausgrid’s ability to meet its obligations under this agreement or the NER, then the parties must meet as soon as possible after the occurrence of the incident to discuss and resolve any relevant issues. (b) On or prior to the meeting convened under clause 7.4(a) (Incident meeting), the parties must provide each other with all relevant information within their possession in relation to the incident. (c) The parties will prepare and exchange a written report (Incident report) which contains the following: (i) a description of the incident and its impact; (ii) the cause of the incident and any relevant findings; and (iii) recommendations to mitigate or prevent a recurrence. (d) If the relevant incident has or has the potential to prevent or restrict Ausgrid's ability to meet its obligations under the NER, the parties must meet and negotiate in good faith to agree any necessary or appropriate amendments to the terms and conditions of this agreement, to ensure compliance.
