Storage of Hazardous Substances. Compressed gas cylinders or vessels containing liquids or gas under pressure should be stored in a safe manner. It will be the responsibility of the organiser to ensure that it is stored and used safely by obtaining health and safety approval for the location. Any pressurised cylinders, flammable gas cylinders or equipment producing pressurized the external skin of the building. The location of equipment must also be clear of any fire exit, including any fire hoses. It shall be the responsibility of that any equipment used to produce, supply or transfer gases (including air) is switched off and without risk, at the close of daily exhibition activities, where a 24-hour requirement is not provided.

Except as described on SCHEDULE 6.34, there are no aboveground or underground tanks located on the Real Property used or formerly used for the purpose of storing any Hazardous Substance, to the best of the Selling Parties' knowledge and there are no Hazardous Substances stored on the Real Property except as needed for use in maintenance and repair of the Assets.

Storage of Hazardous Substances. To the best of the Tenant’s knowledge, information and belief, and except as set forth in the “Final Report, ECRA/ISRA Compliance, Capscan Cable Company, Freehold, Monmouth County, ISRA Case No. 89100” dated March 1994 and prepared by ENVIRON Corporation, the Premises have not been used by Tenant, any tenant, subtenant or licensee of the Tenant or any prior owner, tenant, subtenant or licensee of the Premises to refine, produce, store, handle, transfer, process or transport “Hazardous Substances”, as such term is defined in N.J.S. 58:10-23.11b(k), except in accordance any and all applicable state and federal law. Tenant will not knowingly in the future use nor suffer or permit the Premises to be used for the foregoing purposes unless done (a) in full compliance with any and all applicable state and federal law.

(a) The Parent shall not (and will procure that no other member of the Group will) cause or permit any Hazardous Substance to be brought upon or used in or about any property owned or occupied by any member of the Group, other than Hazardous Substances used in the ordinary course of business in accordance with applicable Environmental Laws and/or Environmental Licences to the extent that to do so would have a Material Adverse Effect.
(b) The Parent shall store in any mariner approved or prescribed by Environmental Law and/or any Environmental Licence, any and all Hazardous Substances permitted within any property owned or occupied by any member of the Group in circumstances where failure to do so would have a Material Adverse Effect.

The CITY may restrict the use or storage of hazardous substances upon determining that the same pose an unreasonable threat to the safety of the public beach or the general public.

Except as set forth on Schedule 4.17, no Hazardous Materials are presently stored or otherwise located, and no underground storage tanks are or were located, on real estate currently or formerly owned, leased or operated by any of the Sellers or their respective Subsidiaries or, to the Knowledge of the Sellers, on adjacent parcels of real estate, and no part of such real estate or, to the Knowledge of the Sellers, no part of such adjacent parcels or real estate, including the groundwater located thereon, is presently contaminated by Hazardous Materials.
