Retail Stores. (a) Permanent full time employees in retail stores may apply to postings for retail stores within the Retail Division, for the purpose of transfer, promotion or demotion, on the following terms and conditions:
(i) The employee has a minimum of three (3) years permanent full time seniority to be considered for transfer requests;
(ii) Upon transfer, the employee is ineligible to apply to or be considered for postings for the purposes of transfer for a period of two (2) years from the date of transfer;
(iii) The employee is responsible for all relocation expenses associated with the transfer or demotion and shall not receive any payment or reimbursement from the Employer in respect of same, except where the employee has been promoted to a Manager position; and
(iv) For the purpose of transfer or promotion, the employee’s performance is satisfactory as determined by the Employer, and the employee receives a recommendation from his/her Supervisor.
(b) Where an employee is being considered for transfer, promotion, or demotion to a posted vacancy, seniority will be the determining factor, provided the employee is qualified to perform the work.
(c) Upon demotion, an employee will receive the wage rate closest to, but not greater than the employee’s current wage rate for the position the employee has been demoted to.
(d) For clarity, Article 22 does not, in any way, restrict management rights to transfer employees for operational or bona fide reasons. The employer will provide the Local President with a copy of an employee’s transfer letter.
(e) It is understood that for the purposes of layoff and identification of posting areas, the current Geographic Areas remain in existence.
Retail Stores. Licensee shall be responsible for the payment, pursuant to the provisions of SECTION 12.1, of all costs and expenses associated with the operation of Licensee Retail Stores in the BTAs. Such costs include, without limitation, all lease and related payments for the retail store locations, all leasehold improvements, all furniture, fixtures, and equipment, all utilities, all telephone systems, and all PC equipment/software in such locations. To the extent that Manager directly pays any of such costs and expenses, Licensee shall reimburse Manager upon the terms and conditions set forth in SECTION 11.
1. The sales representatives and store managers in the Retail Stores will be employees of Licensee. These employees will report to one of Manager's executives (or an employee who reports directly to such executive). Licensee acknowledges and agrees that Manager will have the authority to make all decisions with respect to all aspects of owning and operating the Retail Stores, including without limitation, opening new Retail Stores and eliminating existing Retail Stores.
Retail Stores. Open any additional retail stores during the period from the date hereof through the Termination Date; provided however, that the Companies may open full time stores so long as not more than twenty-five (25) such stores are open at any time.
Retail Stores. Velovita products cannot be offered or sold in retail establishments, or anywhere the product is displayed to the public.
Retail Stores. The Borrower will not, and will not -------------- permit any Subsidiary to, open any new retail store.
Retail Stores. Service and Personal Service uses; and
Retail Stores. With respect to the Corporation’s retail stores, the Corporation shall use its commercially reasonable efforts to enter into direct agreements with third party services providers (including, without limitation, for rent or utilities, even if such retail stores are shared with the Corporation’s Parent or its Affiliates); [COMMERCIALLY SENSITIVE INFORMATION REDACTED];
Retail Stores. Offer (Trademark) products in mall-based, stand-alone and/or street-side retail premises of various sizes including a kiosk model subject to approval by the Franchisor.
Retail Stores. The Seller Retail Stores, the service stations and convenience stores operated by the Jobbers and those service stations and convenience stores (if any) set forth on Schedule 2.2(l) constitute all service stations and convenience stores operated in the Business. Seller has not entered into any commitment or agreement for the expansion or closing of any of the Retail Stores. All service stations or convenience stores owned by Seller and not used in the Business are set forth on Schedule 2.2(l).
Retail Stores. The LDB will maintain a minimum of 185 retail stores during the term of the 15th 16th Master Agreement.
