Storage Products. 3.1. Subject to the availability there shall be Bundled and Unbundled Products bookable on a firm and interruptible basis. 3.2. Subject to the completion and operability of the caverns of the Storage Facility still under construction the Storage Service Provider aims to provide a Bundled Product that shall be composed of the following parameters in the following relation: from 01.04.2017, 06:00 hours (CET) Injection Capacity (maximum): 827 m³/h Withdrawal Capacity (maximum): 1,654 m³/h Working Gas Volume: 1,000,000 m³ subject to further clarification in Article 7 hereof. One bundle shall have 1,000,000 m³ (“Bundle”). 3.3. The following individual types of Bundled Products may be booked: means a Bundled Product with fixed Working Gas Volume, Injection Capacity and Withdrawal Capacity as defined in Article 3.2 hereof with the fixed Storage Period of seventeen (17) Storage Years. means a Bundled Product with fixed Working Gas Volume, Injection Capacity and Withdrawal Capacity as defined in Article 3.2 hereof with the fixed Storage Period of full years from six (6) to sixteen (16) Storage Years. means a Bundled Product with fixed Working Gas Volume, Injection Capacity and Withdrawal Capacity as defined in Article 3.2 hereof with the fixed Storage Period of one (1) to five (5) Storage Years. 3.4. The minimum quantity of the Tzarina Pack Long-Term and Royal Pack Medium-Term shall be one (1) bundle. In case Tzarina Pack Long-term and Royal Pack Medium-Term is only available for a quantity less than one Bundle, the Storage Service Provider shall be entitled to deviate from this minimum quantity. 3.4.1. If it turns out after conclusion of the relevant Storage Service Agreement that the Storage Service Provider will be unable to provide the Storage Capacity initially agreed by the Parties due to circumstances of the cavern`s construction process, i.e. unforeseeable geological difficulties, the Storage Capacity should be adjusted on a pro-rata allocation mechanism as further described in the example of the table below. Storage Products. 3.1. Subject to the availability there shall be Bundled and Unbundled Products bookable on a firm and interruptible basis. 3.2. Storage Service Provider makes available a Bundled Product composed of the following parameters in the following relation (Standard Bundled Unit “SBU”): Injection Capacity (maximum): 9.275 MWh/h Withdrawal Capacity (maximum): 18.55 MWh/h Working Gas Volume: 11,215 MWh subject to further clarification in Article 7 hereof. 3.3. The availability of any Storage Service shall be subject to the limitations of the applicable Injection and Withdrawal curves according to Article 7 hereof. 3.4. In relation to Unbundled Products if available any Storage Customer may book Injection Capacities, Withdrawal Capacities and Working Gas Volumes in a ratio or a combination at the Storage Customer’s sole discretion upon approval by the Storage Service Provider. 3.5. With respect to Interruptible Storage Services the Storage Service Provider may interrupt the Injection and/or Withdrawal Capacities of the Storage Customer completely or partially with at least two (2) Hours’ notice.

Storage Products. 3.1. Throughout the Open Season Procedure in relation to the Storage Facility the Storage Service Provider shall only offer Bundled Products on a firm basis. After the Open Season Procedure subject to the availability there shall be Bundled and Unbundled Products bookable on a firm and interruptible basis. 3.2. Storage Products. During the term of this Agreement, Iomega agrees that it shall consult with and advise Venture as to the design, development and manufacture of Storage Products for and on behalf of Iomega. It is the intent of the Parties that there shall be active and open discussions between the Parties on future Storage Products developed by or for Iomega. Iomega and Venture shall negotiate in good faith the terms and conditions surrounding the design, development and manufacture of any Storage Products by Venture for Iomega. However, if for whatever reason, the Parties cannot agree on a design, development and manufacturing plan, then the matter shall be escalated for review by the CEO of Venture and the CEO of Iomega who shall review and discuss such matter within fifteen (15) days of written notice by one Party to the other requesting such a review. If after fifteen (15) days the Parties, respective CEOs have not reached an agreement, then Iomega shall be free to pursue the design, development and manufacture of such Storage Products at its own discretion.

  • Product ACCEPTANCE Unless otherwise provided by mutual agreement of the Authorized User and the Contractor, Authorized User(s) shall have thirty (30) days from the date of delivery to accept hardware products and sixty (60) days from the date of delivery to accept all other Product. Where the Contractor is responsible for installation, acceptance shall be from completion of installation. Failure to provide notice of acceptance or rejection or a deficiency statement to the Contractor by the end of the period provided for under this clause constitutes acceptance by the Authorized User(s) as of the expiration of that period. The License Term shall be extended by the time periods allowed for trial use, testing and acceptance unless the Commissioner or Authorized User agrees to accept the Product at completion of trial use. Unless otherwise provided by mutual agreement of the Authorized User and the Contractor, Authorized User shall have the option to run testing on the Product prior to acceptance, such tests and data sets to be specified by User. Where using its own data or tests, Authorized User must have the tests or representative set of data available upon delivery. This demonstration will take the form of a documented installation test, capable of observation by the Authorized User, and shall be made part of the Contractor’s standard documentation. The test data shall remain accessible to the Authorized User after completion of the test. In the event that the documented installation test cannot be completed successfully within the specified acceptance period, and the Contractor or Product is responsible for the delay, Authorized User shall have the option to cancel the order in whole or in part, or to extend the testing period for an additional thirty (30) day increment. Authorized User shall notify Contractor of acceptance upon successful completion of the documented installation test. Such cancellation shall not give rise to any cause of action against the Authorized User for damages, loss of profits, expenses, or other remuneration of any kind. If the Authorized User elects to provide a deficiency statement specifying how the Product fails to meet the specifications within the testing period, Contractor shall have thirty (30) days to correct the deficiency, and the Authorized User shall have an additional sixty (60) days to evaluate the Product as provided herein. If the Product does not meet the specifications at the end of the extended testing period, Authorized User, upon prior written notice to Contractor, may then reject the Product and return all defective Product to Contractor, and Contractor shall refund any monies paid by the Authorized User to Contractor therefor. Costs and liabilities associated with a failure of the Product to perform in accordance with the functionality tests or product specifications during the acceptance period shall be borne fully by Contractor to the extent that said costs or liabilities shall not have been caused by negligent or willful acts or omissions of the Authorized User’s agents or employees. Said costs shall be limited to the amounts set forth in the Limitation of Liability Clause for any liability for costs incurred at the direction or recommendation of Contractor.
