Common use of SUB-CONTRACTOR Clause in Contracts

SUB-CONTRACTOR. Attachment A - BCOE Template Contract for B2W Program understands and agrees that the maximum total payment amount is provided as an estimate. SUB-CONTRACTOR agrees that if funding from the State of California for any fiscal year is reduced or deleted by the Budget Act for purposes of this Program, BCOE shall have the option to terminate this Contract immediately with no liability occurring to BCOE, or offer a Contract amendment to SUB- CONTRACTOR to reflect the reduced amount. The BCOE shall provide written notice to SUB-CONTRACTOR upon learning that State of California funding will be so reduced or deleted.
