Compliance with Standard Transactions. If Business Associate conducts, in whole or in part, Standard Transactions (as such term is defined in the Standards for Electronic Transactions Rule at 45 CFR Parts 160 and 162, as may be amended, modified or superseded, from time to time) for or on behalf of Covered Entity, Business Associate will comply, and will require any of its subcontractors or agents involved with such Standard Transactions on behalf of Covered Entity to comply, with each applicable requirement of 45 CFR Parts 160 and 162. Business Associate will not enter into, or permit its subcontractors or agents to enter into, any agreement in connection with the conduct of Standard Transactions for or on behalf of Covered Entity that: (i) changes the definition, data condition, or use of a data element or segment in a Standard Transaction; (ii) adds any data elements or segments to the maximum defined data set; (iii) uses any code or data element that is marked "not used" in a Standard Transaction or are not in the Standard Transactions' implementation specification; or (iv) changes the meaning or intent of the Standard Transactions' implementation specifications.
Compliance with Standard Transactions. If Business Associate conducts, in whole or part, Standard Transactions for or on behalf of Company, Business Associate will comply, and will require any subcontractor or agent involved with the conduct of such Standard Transactions to comply, with each applicable requirement of 45 C.F.R. Part 162. Business Associate will not enter into, or permit its subcontractors or agents to enter into, any Trading Partner Agreement in connection with the conduct of Standard Transactions for or on behalf of Company that:
1. Changes the definition, data condition, or use of a data element or segment in a Standard Transaction;
2. Adds any data element or segment to the maximum defined data set;
3. Uses any code or data element that is marked “not used” in the Standard Transaction’s implementation specification or is not in the Standard Transaction’s implementation specification; or
4. Changes the meaning or intent of the Standard Transaction’s implementation specification.
Compliance with Standard Transactions. When required, the Parties shall comply with each applicable regulation when performing "Standard Transactions." The Parties will not enter into any Trading Partner Agreement related to this Agreement that: changes any definition, data condition or use of a data element or segment, nor adds any data elements or segments to the maximum defined data set as proscribed in the HHS Transaction Standard Regulation, and as further proscribed by MSBCBS. (See 45 CFR § 162.915(b)). The Parties further agree that they will neither use any code or data elements marked “not used” or which are not found in the HHS Transaction Standard’s implementation specifications, nor change the meaning or intent of any of the HHS Transaction Standard implementation specifications. (See 45 CFR § 162.915(c)(d)).
Compliance with Standard Transactions. When required, the Parties shall comply with the applicable requirements of law or regulation when performing Standard Transactions. The Parties will not enter into any Trading Partner Agreement related to this Agreement that: changes any definition, data condition or use of a data element or segment, nor adds any data elements or segments to the maximum defined data set as proscribed in the HHS Transaction Standard Regulation, and as further proscribed by Highmark. (See 45 CFR § 162.915(b)). The Parties further agree that they will neither use any code or data elements marked “not used” or which are not found in the HHS Transaction Standard’s implementation specifications, nor change the meaning or intent of any of the HHS Transaction Standard implementation specifications. (See 45 CFR § 162.915(c)(d)). Without limiting the generality of Section XII, this Section IX shall survive termination of this Agreement.
Compliance with Standard Transactions. 1. If Business Associate conducts in whole or part Standard Transactions, for or on behalf of Company, Business Associate will comply, and will require any subcontractor or agent involved with the conduct of such Standard Transactions to comply, with each applicable requirement of 45 C.F.R. Part 162 for which HHS has established Standards. Business Associate will comply by a mutually agreed date, but no later than the date for compliance with all applicable final regulations, and will require any subcontractor or agent involved with the conduct of such Standard Transactions, to comply, with each applicable requirement of the Transaction Rule 45 C.F. R. Part 162. Business Associate agrees to demonstrate compliance with the Transactions by allowing Company to test the Transactions and content requirements upon a mutually agreeable date. Business Associate will not enter into, or permit its subcontractors or agents to enter into, any trading partner agreement in connection with the conduct of Standard Transactions for or on behalf of Company that:
a) Changes the definition, data condition or use of a data element or segment in a Standard Transaction.
b) Adds any data elements or segments to the maximum defined data set;
c) Uses any code or data element that is marked “not used” in the Standard Transaction’s Implementation Specification or is not in the Standard Transaction’s Implementation Specification; or
d) Changes the meaning or intent of the Standard Transaction’s Implementation Specification.
Compliance with Standard Transactions. When required, the Parties shall comply with the applicable requirements of law or regulation when performing Standard Transactions to include not entering into any Trading Partner Agreement related to this Agreement that changes any definition, data condition or use of a data element or segment, nor adds any data elements or segments to the maximum defined data set as proscribed in the HHS Transaction Standard Regulation, or as further proscribed by Highmark; and, neither using any code or data elements that are either marked “not used,”or are not found in the HHS Transaction Standard’s implementation specifications, nor changing the meaning or intent of any of those specifications. (See 45 CFR §§ 162.915(b)(c)(d)). Section IX shall survive termination of this Agreement.
Compliance with Standard Transactions. If Business Associate conducts Standard Transactions with or on behalf of Covered Entity, Business Associate will comply with each applicable requirement of 45 CFR Part 162 and will require any Subcontractor or agent involved with the conduct of such Standard Transactions to similarly comply.
Compliance with Standard Transactions. Business Associate will comply with each applicable requirement for Standard Transactions established in 45 Code of Federal Regulations Part 162 when conducting all or any part of a Standard Transaction electronically for, on behalf of, or with the Plan.
Compliance with Standard Transactions. Covered Entity is obligated to conduct Standard Transactions, as that term is defined in 45 C.F.R. § 162.103 in accordance with the requirements of 45
Compliance with Standard Transactions. A. If Company conducts all or part of an electronic transaction on behalf of Covered Entity, Company will comply and will require any Subcontractor involved with the conduct of such Standard Transactions to comply, with each applicable requirement of 45 C.F.R. Parts 160 and 162.
B. In compliance with 45 C.F.R. §162.915, Company will not enter into, or permit any Subcontractor to enter into, any trading partner agreement in connection with the conduct of Standard Transactions for or on behalf of Covered Entity that:
1. Changes the definition, data condition or use of a data element or segment in a standard
2. Adds any data elements or segments to the maximum defined data set
3. Uses any code or data elements that are either marked “not used” in the standard’s implementation specification or are not in the standard’s implementation specification(s)
4. Changes the meaning or intent of the standard’s implementation specification(s), as these terms are defined in 45 C.F.R. Part 162
