Subscriber Warranty. Subscriber represents and warrants that any Subscriber Content hosted by Anitian as part of the Products shall not (a) infringe any copyright, trademark, or patent; (b) misappropriate any trade secret; (c) be deceptive, defamatory, obscene, pornographic or unlawful; (d) contain any viruses, worms or other malicious computer programming codes intended to damage Anitian's system or data; or (e) otherwise violate the rights of a third party. Anitian is not obligated to back up any Subscriber Content; the Subscriber is solely responsible for creating backup copies of any Subscriber Content at Subscriber's sole cost and expense. Subscriber agrees that any use of the Products contrary to or in violation of the representations and warranties of Subscriber in this section constitutes unauthorized and improper use of the Products.
Subscriber Warranty. Subscriber represents and warrants that any Subscriber Content hosted by SmartForce as part of the SmartForce Service shall not (a) infringe, misappropriate or violate any Intellectual Property Rights, publicity/privacy rights, law or regulation; (b) be deceptive, defamatory, obscene, pornographic or unlawful; (c) contain any viruses, worms or other malicious computer programming codes intended to damage, surreptitiously intercept or expropriate any system, data or personal or personally identifiable information; or (d) otherwise violate the rights of a third party. SmartForce is not obligated to back up any Subscriber Content; the Subscriber is solely responsible for creating backup copies of any Subscriber Content at Subscriber’s sole cost and expense. Subscriber agrees that any use of the SmartForce Service contrary to or in violation of the representations and warranties of Subscriber in this section constitutes unauthorized and improper use of the SmartForce Service.
Subscriber Warranty. Subscriber warrants and covenants that (i) Subscriber’s use of the Services shall comply with all applicable laws, (ii) Subscriber shall only provide Authorized Passwords to Permitted Users and shall treat, and require its Permitted Users to treat, such Authorized Passwords as confidential using at least a reasonable standard of care, and (iii) Subscriber and its Permitted Users shall not attempt to access the PLM On Demand System except in accordance with the terms of this Agreement.
Subscriber Warranty. Subscriber represents and warrants that any Subscriber Data hosted by AirWorks as part of the Services shall not (a) infringe or misappropriate any Intellectual Property Rights of any person; (b) be deceptive, defamatory, obscene, or unlawful; (c) contain any viruses, worms or other malicious computer programming codes intended to damage AirWorks’ systems or data; or (d) otherwise violate the rights of any person. Subscriber acknowledges that online services may suffer occasional disruptions and Subscriber may not be able to retrieve Subscriber Data as a result. AirWorks recommends that Subscriber backup Subscriber Data regularly. Subscriber is at all times responsible for storing and maintaining any such backup copies of Subscriber Data at Subscriber’s sole cost and expense. Subscriber agrees that any use of the Services contrary to or in violation of the representations and warranties of Subscriber in this section constitutes unauthorized and improper use of the Services.
Subscriber Warranty. Subscriber represents and warrants that it has the requisite corporate power and authority to enter into this Agreement and to make the commitments set forth in this Agreement and that it is not a party to any other agreement which would hinder its ability to perform its obligations hereunder.
Subscriber Warranty. Subscriber represents and warrants that (a) prior to using the Services in connection with any individual end user, Subscriber shall have obtained the consent of such end user to contact such end user via the Services in such form as required to comply with applicable law; (b) that its use of the Services will comply with all applicable requirements of the Federal Trade Commission, Federal Communications Commission and U.S. Department of Education; and (c) the Subscriber Content shall not (i) infringe any copyright, trademark, or patent right; (ii) misappropriate any trade secret; (iii) be deceptive, libelous, obscene, pornographic or unlawful; (iv) contain any viruses, worms or other malicious computer programming codes intended to damage NameCoach’s system or data; or (v) otherwise violate any privacy or other right of any third party.
Subscriber Warranty. Subscriber warrants and represents to Markit that:
(a) Subscriber’s use of the Services shall not violate any applicable local, state, national or international law, statute, ordinance, rule or regulation, including those relating to Personal Data (as herein defined);
(b) where Subscriber supplies to Markit Subscriber Content belonging to a third party, Subscriber has obtained the necessary consents and authority in order to do so; and
(c) Subscriber has the full right, power and authority to accept, deliver and perform these Terms of Use in accordance with their terms.
Subscriber Warranty. Subscriber represents and warrants to Company that: (a) it has the power and authority to enter into the Agreement; (b) the Subscriber Data shall not contain any Malicious Code; (b) the Subscriber Data shall not infringe any copyright, trademark or patent right or misappropriate any trade secret; and (c) it shall comply with applicable law in using the Services, including the collection, use and disclosure of Subscriber Data in accordance with applicable law.

Subscriber represents and warrants that any Subscriber Content related to or utilized by the Services shall not (a) infringe any copyright, trademark, or patent; (b) misappropriate any trade secret; (c) be deceptive, defamatory, obscene, pornographic or unlawful; (d) contain any viruses, worms or other malicious computer programming codes rights of a third party. Anitian is not obligated to back up any Subscriber Content; the Subscriber cost and expense. Subscriber agrees that any use of the Services contrary to or in violation of the representations and warranties of Subscriber in this section constitutes unauthorized and improper use of the Services.
Subscriber Warranty. Subscriber represents and warrants that, at the time it provides any Subscriber Files to the provider and at all times during which such Subscriber Files are stored in connection with the Services, it is the owner of all such Subscriber Files, and all confidential information contained therein, and has full authority to provide the Subscriber Files to the Provider as contemplated by this Agreement. Subscriber represents and warrants that no Subscriber Files infringe upon or violate any patent, copyright, trademark, trade secret or other proprietary right or any contractual right or privacy right of any third party. Subscriber further represents and warrants that it is duly authorized to enter into this Agreement and make the commitments set forth herein.
