Subscriber Written Consent Required. Subscriber Organization shall obtain and maintain from each Subscriber an executed data consent form, in such form as required by Company, allowing Company to share information regarding the Subscriber with Subscriber Organization in order, among other things, for Subscriber Organization to verify Subscriber’s eligibility to hold a Subscription and the size and amount of such Subscription are consistent with the Community Solar Act. A copy of the form shall be delivered to Company prior to Subscriber Organization’s inclusion of the Subscriber in any Billing Data. If a Subscriber has failed to sign a data consent form, or a signed form has not been provided to Company, Company will have no obligation to issue a bill credit to the Subscriber. Company shall not be liable for any delay or error in the issuance of a bill credit if the Subscriber has not signed the data consent form or the form has not been provided to Company. The Subscriber Organization shall preserve the privacy expectations of the Subscribers under Applicable Law, such as not publicly providing a Subscriber’s account information, usage information or the amount of the bill credit. Subscriber Organization will not disclose such information to third parties, other than to the NMPRC, the New Mexico Office of Attorney General, or to its Receiving Party’s Representatives pursuant to Section 18.1, unless the Subscriber has provided written consent, or such disclosure is compelled by law or regulation.
