Subscriptions, Bundles, and Location Based Experience (LBE) Programs i) The Platform may offer You the ability to participate in other Programs including but not limited to Subscription Programs, Bundle Programs, and/or LBE Programs. A “Subscription Program” is a service where users can access and use on a limited basis select Products curated and promoted by HTC in exchange for a monthly fee established by HTC. A “Bundle Program” offers users the ability to purchase a bundle of Products selected and promoted by HTC in exchange for a one-time fee established by HTC. An “LBE Program” provides an opportunity for Your Product to be used (in exchange for fees established by HTC) in commercial settings such as arcades, internet cafes, movie theaters, educational institutions, amusement parks, shopping malls, and other such venues where HTC sources and manages the relationships with the related operators and HTC may provide components of the operational system infrastructure. ii) Participation in these Programs will be at Your election and subject to HTC’s approval. If You elect to distribute Your Products through a Subscription Program, Bundle Program, and/or LBE Program, and if Your Product is experienced or purchased by a user in a given month as part of that Program, then, for that usage or purchase, in lieu of the payment model described above, Your compensation will be determined as follows: You will be allocated Your proportionate share of the amount HTC or its Third-Party Seller collects from that Program in that month after applicable Program costs have been deducted. Your proportionate share will be based on factors reasonably determined by HTC. Factors include but are not limited to: Number of times Your Product was downloaded, launched, accessed, used, or experienced in that month relative to other Products in that Program; amount of time Your Product was used in that month relative to other Products in that Program; the standard price and/or download popularity of Your Product relative to the other Products included in that Program; and/or the total number of Products in the Program that were downloaded, launched, accessed, used, or experienced in that month. HTC’s methodology to determine the Developers’ proportionate share may vary among these Programs or categories of Products included in these Programs. iii) A Platform Fee will be charged and subtracted from Your proportionate share and the remainder will be remitted back to You less Your share of any applicable taxes, refunds, charge backs, currency charges, or ...

  • PREVAILING WAGE RATES - PUBLIC WORKS AND BUILDING SERVICES CONTRACTS If any portion of work being Bid is subject to the prevailing wage rate provisions of the Labor Law, the following shall apply:

  • Loop Provisioning Involving Integrated Digital Loop Carriers 2.6.1 Where Xxxx has requested an Unbundled Loop and BellSouth uses IDLC systems to provide the local service to the End User and BellSouth has a suitable alternate facility available, BellSouth will make such alternative facilities available to Xxxx. If a suitable alternative facility is not available, then to the extent it is technically feasible, BellSouth will implement one of the following alternative arrangements for Xxxx (e.g. hairpinning): 1. Roll the circuit(s) from the IDLC to any spare copper that exists to the customer premises. 2. Roll the circuit(s) from the IDLC to an existing DLC that is not integrated. 3. If capacity exists, provide "side-door" porting through the switch. 4. If capacity exists, provide "Digital Access Cross Connect System (DACS)- door" porting (if the IDLC routes through a DACS prior to integration into the switch). 2.6.2 Arrangements 3 and 4 above require the use of a designed circuit. Therefore, non- designed Loops such as the SL1 voice grade and UCL-ND may not be ordered in these cases. 2.6.3 If no alternate facility is available, and upon request from Xxxx, and if agreed to by both Parties, BellSouth may utilize its Special Construction (SC) process to determine the additional costs required to provision facilities. Xxxx will then have the option of paying the one-time SC rates to place the Loop.

  • SERVICE REQUIREMENTS FOR REFERRED CLIENTS A. Agent agrees to respond to any communications from a Referred Client within two (2) hours after receipt if such communication is received between 9:00am to 5:00pm local time. For communications received outside of these hours, Agent agrees to respond by 10:00am the next day. B. Agent agrees to update XXXX.xxx with status updates within 48 hours after initial communication with a Referred Client and upon every significant status change until closing or abandoned. Updates shall be made by Agent via email to xxxxxxxxxxxx@xxxx.xxx. C. Vacations or extended absences shall be reported, with length of pause, to XXXX.xxx via email to D.   • Approved Services; Additional Services Registry Operator shall be entitled to provide the Registry Services described in clauses (a) and (b) of the first paragraph of Section 2.1 in the Specification 6 attached hereto (“Specification 6”) and such other Registry Services set forth on Exhibit A (collectively, the “Approved Services”). If Registry Operator desires to provide any Registry Service that is not an Approved Service or is a material modification to an Approved Service (each, an “Additional Service”), Registry Operator shall submit a request for approval of such Additional Service pursuant to the Registry Services Evaluation Policy at xxxx://xxx.xxxxx.xxx/en/registries/rsep/rsep.html, as such policy may be amended from time to time in accordance with the bylaws of ICANN (as amended from time to time, the “ICANN Bylaws”) applicable to Consensus Policies (the “RSEP”). Registry Operator may offer Additional Services only with the written approval of ICANN, and, upon any such approval, such Additional Services shall be deemed Registry Services under this Agreement. In its reasonable discretion, ICANN may require an amendment to this Agreement reflecting the provision of any Additional Service which is approved pursuant to the RSEP, which amendment shall be in a form reasonably acceptable to the parties.
