Common use of Sunday Work Clause in Contracts

Sunday Work. No work shall be performed on a Sunday without the permission of the Regional Chamber, and whenever an employee, other than a normal shift worker, is required or permitted to work on a Sunday, his employer shall either: (a) pay the employee: (i) if he so works for a period not exceeding four hours, not less than the ordinary wage payable in respect of the period ordinarily worked by him on a weekday; or (ii) if he so works for a period exceeding four hours, wages, at a rate of not less than double his ordinary rate of pay, in respect of the total period worked on such Sunday, or the wage which is not less than double the ordinary wage payable in respect of the period ordinarily worked by him on a weekday, whichever is the greater; or (b) pay the employee not less than one and a half times his ordinary hourly wage in respect of each hour worked on such Sunday and grant him within seven days of such Sunday, one work day, i.e. a day other than a Saturday or Sunday, as a holiday, and pay him in respect thereof not less than eight and a half hours' remuneration: Provided that for the purposes of this subclause, a piece-worker shall be paid not less than the equivalent amount to which he would have been entitled had he been employed as a time-worker.

Sunday Work. No Work on Sundays is voluntary and a farm worker can therefore not be forced to work shall on a Sunday. If a farm worker performs work which in the ordinary course of events is required to be performed on a Sunday without the permission of the Regional Chamber, and whenever an employee, other he shall be paid- (a) if he/she has worked for not longer than a normal shift worker, is required or permitted to work two hours on a Sunday, his employer shall either: (a) pay the employee: (i) if he so works for an amount calculated at a period not exceeding four hours, not less than the rate of double his/her ordinary wage payable in respect of the period whole time worked by him/her: Provided that the minimum amount payable shall not be less than this ordinary wage for two hours or; (b) if he/she has worked for longer than two hours but not longer than five hours on a Sunday, an amount of not less the wage payable to him/her in respect of the time (excluding overtime) ordinarily worked by him him/her on a weekday; or (iic) if he so works he/she has worked for a period exceeding four hourslonger than five hours on Sunday, wages, an amount which shall not be less than either an amount calculated at a rate of not less than double his ordinary rate of pay, wage in respect of the total period whole time worked by him/her on such a Sunday, or an amount equal to double the wage which is not less than double the ordinary wage payable to him in respect of the period time (excluding overtime) ordinarily worked by him him/her on a weekday, whichever amount is the greater; orand (d) grant him/her, without remuneration, any ordinary working day in the next succeeding week as a day on which he/she is not required to work, if he/she has worked the hours contemplated in paragraph (b) pay the employee not less than one and a half times his ordinary hourly wage in respect of each hour worked on such Sunday and grant him within seven days of such Sunday, one work day, i.e. a day other than a Saturday or Sunday, as a holiday, and pay him in respect thereof not less than eight and a half hours' remuneration: Provided that for the purposes (c) of this subclause, a piece-worker shall be paid not less than the equivalent amount to which he would have been entitled had he been employed as a time-workersection.
