SUPERINTENDENCE AND SUPERVISION. 3.4.1 The instructions of CITY are to be given through CONSULTANT, which instructions are to be strictly and promptly followed in every case. XXXX shall keep on the Project site during its progress, a competent, full time, English speaking Superintendent or Supervisor (“Superintendent”) and any necessary assistants, all satisfactory to the CONSULTANT and PROJECT MANAGER. The Superintendent or Supervisor shall not be changed except with the written consent of PROJECT MANAGER, unless the Superintendent or Supervisor proved to be unsatisfactory to XXXX and ceases to be in its employ. The Superintendent or Supervisor shall represent XXXX and all direction given to the Superintendent or Supervisor shall be as binding as if given to XXXX and will be confirmed in writing by CONSULTANT. XXXX shall give efficient supervision to the Work, using its best skill and attention. 3.4.2 XXXX’x Superintendent or Supervisor shall record, at a minimum, the following information in a bound log on a daily basis: the day; date; weather conditions and how any weather conditions affected the progress of the work; time of commencement of work for the day; the work being performed; materials, labor, personnel, equipment and subcontractors at the PROJECT site; visitors to the PROJECT site including representatives of CITY, CONSULTANT, regulatory authorities; any special or unusual conditions or occurrences encountered; and the time of termination of work for the day. All information shall be recorded in the daily log in ink. The daily log shall be kept on the PROJECT site and shall be available at all times for inspection and copying by the PROJECT MANAGER and CONSULTANT. 3.4.3 XXXX, CONSULTANT and PROJECT MANAGER shall meet at least every two weeks or as otherwise determined by CONSULTANT and/or PROJECT MANAGER during the course of the WORK to review and agree upon the WORK performed to date and to establish the controlling items of work for the next two weeks. CONSULTANT shall publish, keep, and distribute minutes of, and any comments on, each such meeting. 3.4.4 XXXX shall supervise and direct the work competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work in accordance with the CONTRACT DOCUMENTS. XXXX shall be solely responsible for the means, methods, techniques, sequences and procedures of construction.

In which case, CONTRACTOR shall immediately notify CA upon the Project Manager’s dismissal in writing with identification of CONTRACTOR’s replacement Project Manager. The Superintendent or Supervisor CONTRACTOR’s Project Manager shall represent XXXX CONTRACTOR and all direction given to the Superintendent or Supervisor CONTRACTOR’s Project Manager shall be as binding as if given to XXXX CONTRACTOR and will be confirmed in writing by CONSULTANT. Copies of daily logs must be maintained electronically unless otherwise required by the PROJECT MANAGER CPM. Printed copies of such electronic logs shall be prepared and CONSULTANTprinted daily, kept on file, and shall be available to CA, CPM or Consultant at the Project site for inspection, printing and copying. 3.4.3 XXXX3.5.3 The CONTRACTOR, CONSULTANT PMO, CPM, Consultant and PROJECT MANAGER CA shall meet at least every two weeks weekly or as otherwise determined by CONSULTANT and/or PROJECT MANAGER the CPM or CA during the course of the WORK Work to review and agree upon the WORK work performed to date and to establish review the controlling items Controlling Items of work Work for the next two weeks. The Superintendent or Construction Supervisor shall represent XXXX Contractor at the Project Site during Phase IV and all direction directions given to the Superintendent or Construction Supervisor shall be as binding as if given to XXXX Contractor and will be confirmed in writing by CONSULTANTCity’s Project Manager upon the written request of Contractor. During Phases I-III the City’s Project Manager shall give all directions to the Contractor through the Contractor’s Project Manager. The City’s Project Manager, CONSULTANT and PROJECT MANAGER Contractor shall meet at least every two (2) weeks or as otherwise determined by CONSULTANT and/or PROJECT MANAGER the City’s Project Manager, during the course of the WORK Work to review and agree upon the WORK Work performed to date and to establish the controlling items of work for the next two weeksoutstanding issues. CONSULTANT The Contractor shall publish, keep, and distribute minutes of, and any comments on, thereto of each such meeting. 3.4.4 XXXX . Contractor shall supervise and direct the work Work competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work in accordance with the CONTRACT DOCUMENTSContract Documents and Contract Documents. All Work, including trade Work shall be performed and supervised by properly licensed personnel for the Work being performed.

XXXX The Contractor shall keep maintain a competent resident supervisor, who shall serve as the Designated Representative, and any necessary assistants on the Project site during its progress, a competent, full time, English speaking Superintendent or Supervisor (“Superintendent”) and any necessary assistants, all satisfactory to throughout the CONSULTANT and PROJECT MANAGERduration of the Project. The Designated Representative shall serve as the Superintendent or Supervisor on site and shall be responsible for continuous field supervision, coordination, and completion of the work. The Designated Representative shall not be changed except with the written consent of PROJECT MANAGERthe Project Manager, unless the Superintendent or Supervisor proved Designated Representative proves to be unsatisfactory to XXXX the Contractor and ceases to be in its employ. The Superintendent or Supervisor Project Representative shall represent XXXX the Contractor, and all direction given to the Superintendent or Supervisor Designated Representative shall be as binding as if given to XXXX and the Contractor. Directions will be confirmed in writing by CONSULTANT. XXXX shall give efficient supervision to the Work, using its best skill and attentionContractor. Other directions will be so confirmed on written request in each case. 3.4.2 XXXX’x Superintendent or Supervisor 16.2 The Contractor's Designated Representative shall recordprepare, at on a minimumdaily basis and keep on the Project site, the following information in a bound log on setting forth at a daily basisminimum for each day: the day; date; weather conditions and how any weather conditions affected the progress of the work; time of commencement of work performed; equipment utilized for the daywork; the work being performed; materials, labor, personnel, any idle equipment and subcontractors at the PROJECT sitereasons for idleness; visitors to the PROJECT site including representatives of CITY, CONSULTANT, regulatory authoritiesProject site; any special or unusual conditions or occurrences encounteredlabor utilized for the work; and any materials delivered to the time of termination of work for the day. All information shall be recorded in the daily log in inkProject site. The daily log shall be kept on available for inspection by the PROJECT site and shall be available Project Manager at all times for inspection and copying by during the PROJECT MANAGER and CONSULTANTProject. 3.4.3 XXXX16.3 If the Contractor, CONSULTANT and PROJECT MANAGER shall meet at least every two weeks or as otherwise determined by CONSULTANT and/or PROJECT MANAGER during in the course of the WORK Project, finds any discrepancy between the Contract Documents and the physical conditions of the locality, or any errors or omissions in the Contract Documents, including drawings (plans) and specifications, it shall be the Contractor’s duty to review and agree upon immediately inform the WORK performed to date and to establish the controlling items of work for the next two weeks. CONSULTANT shall publish, keepProject Manager in writing, and distribute minutes of, and any comments on, each the Project Manager will promptly verify the same. Any work done prior to or after such meetingdiscovery shall be done at the Contractor's sole risk. 3.4.4 XXXX 16.4 The Contractor shall supervise coordinate, supervise, and direct the work Project competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work Project in accordance with the CONTRACT DOCUMENTSContract Documents. All Work performed as a result of such discovery, will be done at Contractor's sole risk. If Contractor, in the course of prosecuting the Work, finds any discrepancy between the Contract Documents and the physical conditions of the locality, or any errors, omissions, or discrepancies in the Project Manual, it shall be Contractor's duty to immediately inform Consultant, in writing, and Consultant will promptly review the same. Any work done after such discovery, until authorized, will be done at Contractor's sole risk. 14.5. Contractor shall supervise and direct the work Work competently and efficiently, devoting such attention thereto and applying such skills and expertise as may be necessary to perform the Work in accordance with the CONTRACT DOCUMENTSContract Documents.
