SUPPLY OF PRODUCTS AND SERVICES. 7.1 The Customer acknowledges that before agreeing to purchase any Products and Services from Viridian, the Customer expressly represents and warrants that it has not committed any act of bankruptcy and knows of no circumstances which would entitle any secured creditor to exercise any rights over or against the Customer’s assets.

SUPPLY OF PRODUCTS AND SERVICES. 1.1 The Service Provider hereby agrees to supply certain of the Services described in the Outsourcing Agreement to the Customer Group Company in accordance with the terms of this Local Agreement.

SUPPLY OF PRODUCTS AND SERVICES eleXsys Energy has agreed to supply the Products and/or Services requested in the Customer Schedule and Proposal and the Customer has agreed to purchase the Products and Services from eleXsys Energy in accordance with the terms of this Contract. eleXsys Energy will determine whether a Performance Guarantee will be offered to the Customer in accordance with the process set out in clause 4. eleXsys Energy will decide, in its sole discretion, whether to offer a Performance Guarantee.
SUPPLY OF PRODUCTS AND SERVICES. 4.1 Orders and/or Scope of Works shall be submitted by the Client in writing by post or e-mail and shall specify; a) the Cisilion quotation upon which the Order/Scope of Work is based; b) requested dates of delivery; and c) delivery address; and any special delivery instructions such as location within the delivery address (in the event of any additional reasonable costs incurred by Cisilion due to a failure to give the special delivery instructions the Client shall reimburse Cisilion for those costs); and d) any further information reasonably required by Xxxxxxxx.
SUPPLY OF PRODUCTS AND SERVICES. (a) The operation of the business of the Company as heretofore conducted and as presently conducted, including the Company’s design, development, distribution, marketing, manufacture, use, import, license, and sale of products, technologies and services (including products, technologies and services currently under development by the Company), does not (and did not at any time) obligate the Company to escrow for the benefit of or deliver to third parties Deposit Materials, except as set forth in Section 3.18(a) of the Disclosure Schedule.
SUPPLY OF PRODUCTS AND SERVICES. 2.1 Product Manufacture and Supply. Upon KLS’s agreement to fulfill an Order in accordance with this Agreement, KLS will use commercially reasonable efforts to manufacture and supply the Products designated in the Order in accordance with the terms and conditions of this Agreement. KLS will have no obligation to commence any manufacturing or supply activities with respect to any Products until it agrees to fulfill an Order for such Products as provided herein. If reasonably warranted, KLS may cancel an Order if KLS determines in its reasonable discretion that it needs to do so for biosecurity, safety, infringement, export restrictions and/or feasibility reasons. Any cancellation of an Order as described above shall be without penalty or liability to KLS (provided that any prepaid amounts for such Products shall be promptly refunded to Customer by KLS). If and to the extent expressly specified in the applicable Quotation that any particular Products will be manufactured in accordance with applicable current Good Manufacturing Practices (“GMP”), KLS will manufacture such Products in accordance with GMP and provide any requisite certificates of analysis in connection with any shipment of such Products.
SUPPLY OF PRODUCTS AND SERVICES. 2.1 The Supplier may accept the Purchase Order in writing, by its actions or by conduct, including but not limited to the Supplier’s indication or actions to supply the Products, the Services, or both (as the case may be). If the Supplier indicates to Grosvenor that the Supplier will supply the Products, the Services, or both (as the case may be) or proceeds to supply supply the Products, the Services, or both (as the case may be), the Supplier shall be deemed to accept the Purchase Order and the Terms.
SUPPLY OF PRODUCTS AND SERVICES. 2.1. Caznet Pty Ltd will make available to the Client the products and services as specified in the Service Order on the terms and conditions specified in this Agreement and any documents incorporated into this Agreement and the Service Order by reference upon execution of the Service Order.
