SUPPORT OF COMMISSION MISSION. A. Construction of this series of artificial reefs will augment marine hard bottom habitat with well- planned stable and durable artificial reefs for purposes of providing near shore reef fish habitat, offshore recreational fishing and diving opportunities, reduced pressure on natural reef and hard bottom sites, and reduced user conflicts by providing additional recreational fishing and diving site locations off of Santa Rosa County in state and federal waters of the Gulf of Mexico. The proposed artificial reefs will make fisheries resources available for the long-term benefit of local Florida residents and visitors.

SUPPORT OF COMMISSION MISSION. The mission of the FWC is to manage fish and wildlife resources for their long-term well-being and the benefit of people. The FWC recognizes that scientific data drives management decisions for fish and wildlife populations and their habitats. The North Atlantic right whale is a Federally- designated endangered species. The only known calving grounds for this species are off the coast of northeast Florida and southeast Georgia and have been designated by NOAA Fisheries as Critical Habitat.

SUPPORT OF COMMISSION MISSION. The 2019 State Wildlife Action Plan (SWAP) lists marine conservation actions including, 1) enhance natural shorelines (M1.3), 2) develop and implement strategies to restore habitat and community structure (M5.1), 3) increase management of invasive plant species (M8.1), and 4) restore vegetation to reduce the impact of increased disturbance events (M11.2). This proposal addressed all of these conservation actions to some extent and increases mangrove area to meet Objective 1 of Florida’s Wildlife Legacy Initiative Marine and Estuarine Habitat Enhancement Goal, to complete at least 4 acres of high priority coastal habitat improvement by restoring mangrove habitat.

SUPPORT OF COMMISSION MISSION. Sampling of the recreationally targeted legal size reef fish for polychlorinated biphenyls (PCBs) at the Oriskany Reef is a requirement of the conditions of the February 16, 2006 EPA Region IV Risk based Disposal Permit as amended July 16, 2007 issued to the COMMISSION and Escambia County. This sampling agreement with the GRANTEE provides the guidance and necessary funding to ensure compliance with the February 16, 2006 EPA Region IV Risk based Disposal Permit, and ultimately ensures the human health and safety associated with recreationally targeted legal size reef fish at the Oriskany Reef.

  • Payment of Commission 7 (1) The Company may exercise the power to make payments by way of brokerage or commission conferred by the Law in the manner provided by the Law.

  • Commission Approval The Parties understand and agree that this Agreement will be filed with the Commission for approval by such Commission (or the FCC if the Commission fails to act) pursuant to Section 252 of the Act. Each Party specifically reserves its right to judicial review of this Agreement under Section 252(e)(6) of the Act, or any other available remedy at law or equity. If the Commission, the FCC or any court rejects any portion of this Agreement, the Parties agree to meet and negotiate in good faith to arrive at a mutually acceptable modification of the rejected portion and any provisions that would be materially affected by deletion of the rejected portion; provided that such rejected portion shall not affect the validity of the remainder of this Agreement. The Parties acknowledge that nothing in this Agreement shall limit a Party's ability, independent of such Party's agreement to support and participate in the approval of this Agreement, to assert public policy issues relating to the Act, including challenging the validity of any portion of the Act or an FCC or Commission rule, order, Guideline or other determination made pursuant to the Act, or the application by CBT for suspension or modification of portions of the Act or rules pursuant to Section 251(f)(2) of the Act. In the event CBT obtains a suspension or modification of any portion of the Act or rules thereunder pursuant to Section 252(f)(2) of the Act, the Parties shall negotiate as necessary to incorporate the applicable terms and conditions of such suspension or modification and the Parties agree to negotiate as necessary in order to clarify the application of such suspension or modification to the terms of into this Agreement.

  • CFR PART 200 Procurement of Recovered Materials A non-Federal entity that is a state agency or agency of a political subdivision of a state and its contractors must comply with section 6002 of the Solid Waste Disposal Act, as amended by the Resource Conservation and Recovery Act. The requirements of Section 6002 include procuring only items designated in guidelines of the Environmental Protection Agency (EPA) at 40 CFR part 247 that contain the highest percentage of recovered materials practicable, consistent with maintaining a satisfactory level of competition, where the purchase price of the item exceeds $10,000 or the value of the quantity acquired during the preceding fiscal year exceeded $10,000; procuring solid waste management services in a manner that maximizes energy and resource recovery; and establishing an affirmative procurement program for procurement of recovered materials identified in the EPA guidelines.
