Suspension of Production. In the event NOA deems itself at risk with respect to any claim, action or proceeding under this Section 10, NOA may, at its sole option, suspend production, delivery or order acceptance for any Licensed Products, in whole or in part, pending resolution of such claim, action or proceeding.

Suspension of Production. Should a well drilled hereunder be completed as a well capable of producing oil and/or gas as previously provided herein, Farmee will apply for and diligently seek approval of any requisite SOP (or such other documents, applications and requisite governmental permits) covering the Farmout Acreage, if same is necessary to maintain the Leases and the Unit in full force and effect.
Suspension of Production. Notwithstanding anything to the contrary in this Agreement, upon notice from either Buyer or MHSI that it reasonably believes (based on specific market prices or other public information) that Tax Credits for the current calendar year will be reduced under Section 29(b)(1) by 50% or more, which notice shall include an explanation in reasonable detail of the reasons for such belief, the Members will promptly Consult in good faith and, unless such notice is withdrawn within five Business Days, production will be suspended from the end of such five Business Days until the end of the calendar year (or such earlier date as Members holding 60% or more of the Membership Interests may specify for resuming production).
Suspension of Production. The Director may grant a suspension of production after receiving a Xxxxxx’s written application. The Lessee must show: that they are unable to market Oil and Gas from a well located on the leased premises, which is capable of Oil and Gas production in paying quantities, due to a lack of suitable production facilities of a lack of a suitable market for Oil and Gas and that such condition are outside of the reasonable control of the Lessee, and; that the Lease is not being otherwise maintained in force and effect. The suspension of production cannot exceed one (1) year. The Lessee may request an extension of the suspension of production by submitting a written request to the Director at least thirty (30) days before the suspension period expires. If the well is shut in, and the Director approves the application for suspension of production prior to the expiration or termination of the Lease, then the Lease will be extended, per Section 47-801, Idaho Code, for a period of one (1) year if: (i) the well is shut in; (ii) the Lessee timely submits an application in a form approved by the Director, and; (iii) upon approval of said application, pays a shut-in royalty in the amount equal to double the annual rental, per Subsection 022.02.a, for each well capable of producing Oil or Gas in paying quantities. The Lessee must remit the shut-in royalty payment while the Lease is otherwise maintained in force and effect. Payment of shut-in royalty after the expiration or other termination of the Lease will not revive or extend the Lease. (3-18-22)

Notwithstanding Section 3.3, if there is a temporary cessation of production of Minerals at the Property for any bona fide reason, including without limitation events of Force Majeure (as defined in Section 17.10) or unfavorable market conditions, all required benchmarks, such as but not limited to Current Minimum Production Target, Minimum Cumulative Production Target and Target Rate shall be adjusted and pro rated so as to negate the effect of the time period or periods when any such bona fide cessation of production was occurring.
Suspension of Production. In the event the Company stops grinding corn grain for seven or more consecutive calendar days, then FCStone will be entitled to a pro rata refund of the fees paid in accordance with Section 3 for such days when the Company was not grinding corn. Further, notwithstanding any shutdown, the Company agrees to make the Leased Bins, Company Plant, employees, and contractors reasonably available should FCStone elect to remove Subject Feedstock from the Leased Bins during any production stoppage subject to the Origination Agreement.
Suspension of Production. 23.1 When “Samsung’s” commercial production of this Product is conspicuously poor or is judged to be impossible, “Samsung” shall notify “NGEN” of the reason therefor until 3 months before the suspension of production and consult with “NGEN” about the quantity of the final order and measures thereafter.
