SUSPENSION OF WORK, TERMINATION AND DELAYS. Notwithstanding any other provisions hereunder, the City may cancel the Agreement, suspend Work and terminate the Contract for the convenience of the City in the event that the Contract price increases by fifteen percent (15%) or more. In the event that the City wishes to suspend the Work, it shall issue written notice of suspension to the Contractor. There shall be no “constructive suspension;” only written notice from the Owner to the Contractor shall act to suspend the Work. In the event of suspension by the Owner, Contractor shall be paid its reasonable, direct costs for demobilization and remobilization. If the cost of the work increases during the suspension period due to increases in labor rates, materials or equipment costs, Contractor shall submit all required documentation to the Owner to substantiate such increased costs for the Owner’s consideration of a Change Order. In no event shall Contractor be entitled to or claim any sums for unabsorbed home or field office overhead, lost profits or other consequential or incidental damages. Any termination under this section shall be treated as a termination for convenience under the Contract and subject to the terms and conditions of the Termination for Convenience provision in the Contract.

  • Suspension of Work and Termination 15.01 Owner May Suspend Work

  • Termination of Work Notwithstanding any other term of this Agreement, each of the parties shall be entitled at any time to terminate the Marine Spill Response Services, or any portion thereof, being provided under this Agreement in any given case by giving notice to the other. Upon such notice being provided, Applicable Response Organization shall cease to provide the Marine Spill Response Services or any portion thereof, and shall carry out any required demobilization activities, and Owner shall pay all outstanding Applicable Response Organization Fees and Taxes.

  • Suspension of Work The Department may, at its sole discretion, suspend any or all activities under the Contract, at any time, when it is in the best interest of the State of Florida to do so. The Customer may suspend a resulting contract or purchase order, at any time, when in the best interest of the Customer to do so. The Department or Customer will provide the Contractor written notice outlining the particulars of the suspension. After receiving a suspension notice, the Contractor must comply with the notice and will cease the performance of the Contract or purchase order. Suspension of work will not entitle the Contractor to any additional compensation. The Contractor will not resume performance of the Contract or purchase order until so authorized by the Department.

  • PROJECT TERMINATION AND SUSPENSION 15.1 This Agreement may be terminated during the Pre-Construction Phase by either party upon fifteen (15) days written notice should the other party fail substantially to perform in accordance with its terms through no fault of the party initiating the termination and the breach is not cured or a plan to cure the breach acceptable to the non-breaching party is not established within the fifteen (15) day period.
