Cessation of Work. Any one or all employees working in the immediate proximity when a fatal accident has occurred may without discrimination refrain from working the balance of the shift.
Cessation of Work. Upon oral or written notice by VEIC to Subcontractor to stop all or any part of the Services, Subcontractor shall comply with the terms of such notice by immediately ceasing performance of the Services during the Performance Period until further notice, and by notifying its officers, employees, agents, subcontractors, or any other person acting for or by permission of Subcontractor to stop all work until further notice. Subcontractor will comply with all subsequent instructions provided by VEIC or directly by DOEE.
Cessation of Work. Company may, without any liability to Contractor countermand any Work order given to Contractor at any time before that Work is commenced by Contractor. Company may order the cessation of the Work at any time, being liable to Contractor for only the value of the Work performed prior to the cessation order.
Cessation of Work. 1. If, during the term of a temporary employment contract under which the temporary employment agency has an obligation to continue to pay wages to the temporary worker, the work ceases because the posting order is cancelled, the temporary employment agency will be under an obligation to look for suitable alternative work and to offer it to the temporary worker. The temporary worker is obliged to accept suitable alternative work during the term of this temporary employment contract.
2. Suitable alternative work is understood to mean work that is the same grade as – or not more than two grades lower than – the old job. The job classification in Schedule 4 to this collective agreement provides guidelines for this. The temporary employment agency should also take as much account as possible of the work experience, standard of training and physical aptitude of the temporary worker, the old work pattern and the travelling time to the place of work.
3. If no alternative work can be offered, the temporary employment agency is under the obligation to continue to pay wages to the temporary worker during the term of the temporary employment contract. The temporary worker is entitled to continue to receive his last pay. If suitable alternative work is offered the pay will be determined anew in accordance with the pay ratio rule set out in Article 22. If the new rate of pay is higher than or equal to the old rate of pay, it will apply immediately at the start of the activities.
4. If the new rate of pay is lower than the old rate of pay, the pay will be scaled back to the new rate of pay in three proportionate steps over a period of three months.
5. The scope of the temporary employment contract is determined by the number of hours defined in the contract. If the scope of the work has not been agreed or not clearly agreed, the following will apply. If a temporary employment contract has been in effect for at least three months, the scope of the stipulated work is assumed to be equal to the average scope of the work in each of the three previous months.
6. The obligation to look for and offer suitable alternative work and the obligation to continue to pay wages to the temporary worker lapse if the temporary worker terminates his registration as provided in Article 6, is no longer available for work or refuses an offer of suitable alternative temporary work. Cessation of Work. Neither the Union nor any employee shall take part in or call, or encourage, any strike, sit-down, or any suspension of work against the Company, which shall in any way affect the operations of the Company, nor shall the Company engage in any lockout.
Cessation of Work. (a) The UNION and its members agree that they will not cause, authorize or sanction, nor will the UNION permit its members to cause or take part in any sit-down, or slow-down in any department or any strike or stoppage of any of the COMPANY's operations or any curtailment of work or restriction or interference with production or any picketing of the COMPANY's premises during the term of this Agreement.
(b) The COMPANY agrees that it will not cause or sanction a lockout during the term of this Agreement.
(c) The COMPANY does not expect Foremen to cross a legal picket line, but should a picket line, whether legal or illegal be established, the UNION undertakes and agrees to co-operate with the COMPANY in an attempt to have the picket line removed and, in any event, to ensure a safe and orderly shutdown of the COMPANY's operation. The UNION agrees that Xxxxxxx may stay behind a picket line long enough to ensure such safe and orderly shutdown.
Cessation of Work. In view of the orderly procedure set out in the Agreement for settling differences respecting the interpretation or alleged violation of this Agreement, the Union agrees that there shall be no strike, stoppage, slow down or restriction of output by the employees during the life of this Agreement, and that any or all employees taking part in or instigating any such strike, stoppage, slow down or restriction of output, shall be subject to discharge or other discipline by the Company. On the other hand and for the same reason, the Company agrees that there shall be no lock out during the life of this Agreement.
Cessation of Work. Once commenced, there occurs cessation of the work of construction prior to completion of the Improvements for a continuous period of ten (10) days or more for causes other than those beyond the control of Borrower or consented to in writing by Lender; or
