TARIFF APPLICATION. Customer acknowledges that the Services may be subject, in whole or in part, to one or more provisions of state or federal tariffs or price lists, which may be filed by NEXTERA. In the event of any conflict between any provision of this Agreement and any provision of the tariff or price list, the provision of such tariff or price list will control. This Agreement and the Services will be subject to modifications required or authorized by any regulatory agency in the exercise of its lawful jurisdiction.

In the event of any conflict between any provision of this Agreement or any applicable SOF(s) and any such tariff(s), such tariff(s) will prevail.

In the event of any conflict between any provision of this Agreement and any provision of such tariff, the provision of such tariff will control. This Agreement and any Service Order issued hereunder may not be effective until approved by the FCC or State Commission.
TARIFF APPLICATION. SPP’s OATT shall apply to Transmission Service utilizing the West Facilities-UGP; except that ancillary services applicable only to the Balancing Authority Area(s) in the Western Interconnection shall be according to the Western Interconnection-related ancillary service schedules set forth in Exhibit #2 of this Agreement. Western-UGP shall provide rate schedules including revenue requirements and/or rates to SPP for the WAUW-related ancillary services that Western-UGP, as the Balancing Authority, provides to SPP as the Transmission Provider, if it is capable of doing so. SPP shall provide ancillary services to a Transmission Customer with Transmission Service on the West Facilities-UGP located in the NWMT or WACM if such Transmission Customer does not obtain the necessary ancillary services directly from NorthWestern Energy or Western-RMR, as applicable, or self- supply such ancillary services.
TARIFF APPLICATION. Services may now be, or may later become, subject to Kinex’s tariffs filed with the Federal Communications Commission or another agency.
TARIFF APPLICATION. For Services that are subject to any of Hotwire's tariffs (collectively, the "Tariff") filed with, or regulations of, the FCC, any state commission, or any other government body, board, or commission of competent jurisdiction, the provisions of the Tariff or regulations shall take precedence over conflicting provisions of this Agreement, unless otherwise specifically set forth herein.
