TCEQ Sample Clauses

TCEQ. Notwithstanding any other provision of this Settlement Agreement, the Environmental Custodial Trust Agreement, or any Order approving this Settlement Agreement or the Environmental Custodial Trust Agreement, only the following Sections of this Settlement Agreement shall apply to TCEQ: Section III (Jurisdiction), Section IV (Parties Bound; Succession and Assignment), Section XI (Environmental Custodial Trust), Section XV (Covenant Not to Sue, Releases, and Reservation of Rights), Section XVI (Contribution Protection), Section XVIII (Notices and Submissions), Section XIX (Judicial Approval and Opportunity for Public Comment), Section XX (Plan of Reorganization), Section XXI (Amendments/Integration and Counterparts), Section XXII (TCEQ), and Section XXIII (Retention of Jurisdiction). In addition, Section I (Introduction) and Section II (Definitions) shall apply to TCEQ, but only to the extent that those Sections contain definitions of capitalized terms used in the other Sections identified in this Paragraph. TCEQ expressly reserves, and this Settlement Agreement is without prejudice to, all TCEQ claims against the Debtors for the Many Diversified Interests Site, Xxxxxx Service Site, and French Limited Site located in Texas.

TCEQWater conservation by sub-meter billing is encouraged by the Texas Commission on Environmental Quality (TCEQ). Sub-meter billing is regulated by TCEQ rules, and a TCEQ summary of the rules (called a resident guide) is attached to this addendum. This addendum complies with those rules.

  • COMPTROLLER GENERAL ACCESS The Parties authorize the Comptroller General of the United States (the Government Accountability Office), upon request, to have access to all USAC and the Department records necessary to monitor or verify compliance with this matching Agreement, in accordance with 5 U.S.C. § 552a(o)(l)(K). This Agreement also authorizes the Comptroller General to inspect any records used in the matching process covered by this matching Agreement under 31 U.S.C. § 717 and 5 U.S.C. § 552a(b)(10).

  • CEQA Activities funded under this Grant Agreement, regardless of funding source, must be in compliance with the California Environmental Quality Act (CEQA). (Pub. Resources Code, § 21000 et seq.) Any work that is subject to CEQA and funded under this Agreement shall not proceed until documents that satisfy the CEQA process are received by the DWR Grant Manager and the State has completed its CEQA compliance. Work funded under this Agreement that is subject to a CEQA document shall not proceed until and unless approved by the Department of Water Resources. Such approval is fully discretionary and shall constitute a condition precedent to any work for which it is required. If CEQA compliance by the Grantee is not complete at the time the State signs this Agreement, once the State has considered the environmental documents, it may decide to require changes, alterations, or other mitigation to the Project; or to not fund the Project. Should the State decide to not fund the Project, this Agreement shall be terminated in accordance with Paragraph 10, “Default Provisions.”

  • Environmental Health and Safety i. Environment, Health and Safety Performance. Seller acknowledges and accepts full and sole responsibility to maintain an environment, health and safety management system ("EMS") appropriate for its business throughout the performance of this Contract. Buyer expects that Seller’s EMS shall promote health and safety, environmental stewardship, and pollution prevention by appropriate source reduction strategies. Seller shall convey the requirement of this clause to its suppliers. Seller shall not deliver goods that contain asbestos mineral fibers.
